토지경계분쟁의 해결을 위한 개선방안에 관한 연구 = A Study on the Improvement Method for Solution of Land Boundary Disputes

국문 초록 (Abstract)

토지경계는 하나의 필지를 구성하는데 있어서 가장 중요한 성립요건이며, 소유권이 미치는 한계로써 매우 중요한 역할을 하고 있으며 우리나라는 토지경계 분쟁시 특별한 사정이 없는 한 도상경계를 법정경계로 사용함으로써 지상경계와 도상경계에 따른 소유권 분쟁시 해결의 기준으로 사용하고 있다. 이 연구는 토지 경계분쟁에 대한 문제점을 분석하고, 이를 토대로 토지 경계분쟁의 개선방안을 제시하는데 목적이 있다.
토지가 가지고 있는 경계의 중요성으로 인한 여러 가지 관리기법의 한계로 인하여 토지의 생성 및 소유권의 발생이후 현재까지 토지경계분쟁을 유발하여 왔다. 이는 등록의 주체인 국가나 소유의 주체인 토지소유자가 일방적 관리행위의 결과이기는 하나 상린하는 경계의 상충성 때문에 발생할 수 밖에 없는 필연적 문제이기도 하다. 이러한 토지경계분쟁의 원인을 토지등록의 주체인 국가의 법적·제도적 장치의 미비, 지적공부관리의 기술적 취약, 지적제도운영의 비효율성으로 구분하여 그 문제점을 제시하였다.
경계분쟁에 대한 방어성의 향상을 위해서 지적측량에 대한 검사측량의 전문성을 확보할 수 있는 방안으로, 책임성 있는 지적측량 검사단을 구성하여 실질적인 검사측량이 이루어져야 하며, 토지의 경계를 명확히 하기위해서 경계점표지 및 구획물의 설치 의무화를 통한 경계에 대한 불신을 사전에 방지해야 한다. 경계분쟁에 대한 적부심사 기관인 지방·중앙 지적 위원회의 기능을 한층 강화하여 강력한 경계 확정권을 부여함으로써 사회적 비용의 감소 및 신뢰도의 향상으로 경계분쟁이 줄어든다는 방안을 도출할 수 있었다.

The land boundary is the most important required elements in composing one lot, and plays a very important role as a limit that ownership influences, so our country is using it as a criterion of solution in case of an ownership dispute according to the ground boundary and the map boundary by using the map boundary as the legal boundary, if there is no special situation. The purpose of this study is to analyze problems about land boundary disputes and to suggest an improvement method of the land boundary disputes based on this.
Due to a limit of several management techniques caused by importance of the boundary that land has, the land boundary disputes have been induced until now since land generation and ownership occurrence. This is a result of one-sided management behaviors of the nation which is the subject of registration or a land owner who is the subject of ownership, but it is also an inevitable problem that cannot help occurring because of conflicts of the adjacent boundary.
The reasons of this land boundary disputes were divided into unpreparedness of legal·systematic installations of the nation which is the subject of land registration, technological weakness of cadastral record's management and inefficiency of cadastral system operation, and then the problems were suggested.
As a plan that can secure expertise of an inspection survey about a cadastral survey for improving protectability against the boundary disputes, a cadastral survey's responsible inspection unit is composed and a substantial inspect survey should be carried out, and the disbelief about the boundary through installation obligation of a boundary point mark and division matter should be previously prevented to clarify the boundary of land.
The method that boundary disputes would be reduced due to reduction of social cost and improvement of reliability by strengthening the function of the provincial·central land registration committee more, which is an institute for suitability assessment about the boundary disputes as well as giving powerful boundary decision rights.
