    본 연구에서는 우리나라 저작권법에서 규정하고 있는 저작재산권 제한 중에서 대학도서관에서의 저작물이용과 저작권법 제31조 “도서관 등에서의 복제 등”의 적용을 고찰하였다.
    도서관의 종류 중에서도 대학도서관은 학술정보 유통에 중심적인 역할을 담당하고 있을 뿐만 아니라 학위논문 DB도 구축하는 등 생산에도 관여하고 있다. 따라서 대학도서관은 저작권법 제31조 “도서관 등에서의 복제 등”의 구성 조항 전체를 직접적으로 적용 받고 있으며, 저작권법 제25조 “학교 교육목적 등에의 이용”과도 관련이 있다.
    2000년 개정 저작권법에서 전자도서관 관련 규정이 신설되었으나, 도서관에서의 소장자료 디지털화 및 전송 등에 관하여 많은 논란이 있었다. 이후 2003년 개정 저작권법에서는 전자도서관 관련 조항이 대폭 신설되고, 도서관보상금제가 도입되는 등의 새로운 개념과 제도가 도입되어 현행 저작권법까지 이어지고 있다. 이에 따라 대학도서관에서는 새롭게 개정된 저작권법이 대학도서관에서의 저작물 이용에 어떻게 적용되어야 하는 지를 파악하여야할 필요성이 대두 되었고, 본 연구를 통해 대학도서관에 근무하는 사서의 입장에서 대학도서관 이용자 서비스에 만전을 기하고자 하였다.
    대학도서관에서의 저작물 이용과 저작권법 제31조의 적용에 대하여 고찰하고, 대학도서관이 교육기관에 설치되어 있는 점과 관련하여 저작권법 제25조 학교 교육목적 등에의 이용과 저작권법 제30조 사적이용을 위한 복제도 연관지어 검토한 결과는 다음과 같다.
    첫째, 저작권법은 도서관의 공익성을 인정하여 대학도서관에서의 저작물 이용을 위하여 저작권자의 복제권 및 전송권 등을 일정한 요건 하에서 제한하고 있다. 따라서 대학도서관에서의 저작물 이용시 저작권법이 허용한 면책 요건 내에서 이루어지도록 주의하여야 함을 알 수 있었다. 특히 도서관의 복사서비스에서 도서관의 주도적 관리가 필요하다.
    둘째, 우리 저작권법 제31조 “도서관 등에서의 복제 등”의 면책요건 및 허용범위를 검토한 결과 이용자가 요구하는 복제물을 제공하기 위하여서는 대학도서관이 대학도서관에 소장된 자료를 이용하여, 자료의 일부분을 복사하고, 신청한 이용자에게 1부만을 제공하여야 한다. 따라서 다수의 학생에게 동시에 1부씩 나누어주거나 1명에게 여러 부를 제공하는 것은 허용되지 않는다. 디지털자료를 다른 도서관에 전송하는 경우 또는 도서관 내에서 출력할 경우에는 도서관보상금을 지급하여야 하므로, 대학도서관에서는 이용허락이 필요한 자료와 자유이용이 가능한 자료를 파악하여 관리할 필요가 있다.
    셋째, 대학도서관에서의 저작물이용과 저작권법의 적용 관계에서는, 대학도서관이 제공하는 서비스 중 저작권법과 관련이 많은 열람서비스, 복사ㆍ복제 서비스, 상호대차서비스 등을 중심으로 살펴보았으며, 디지털자료의 열람에 있어서는 공연권 및 공중송신권 등이 관련되고, 이 때 발생하는 일시적인 저장은 복제에 해당되지 않는 것으로 파악 하였다.
    그리고 복사서비스의 저작물의 일부분은 1/3 이하의 양으로 제공하여야 하고, 상호대차서비스에서 사용하는 FAX 및 Ariel 시스템 이용시 발생하는 전송은 아날로그자료의 전달에 따라 부수적으로 발생하는 일시적 저장으로 저작권법의 전송에는 포함되지 않는 것으로 파악하였다.
    넷째, 불법복제 문제로 저작권자 단체 등이 많은 관심을 가지고 있는 대학도서관에서의 복사서비스와 관련하여, 현재의 도서관내 복제기기의 운영에는 저작권법 제31조의 면책요건에서 허용하는 범위를 넘어 운용되고 있는 부분이 많아, 대학도서관 복사서비스의 시급한 개선이 필요하다.
    대학도서관은 도서관으로서의 기능과 교육기관으로서의 역할을 수행하여야 하는 이중적 지위에 있다고 생각되며, 대학도서관의 이용자 또한 교육기관의 교원 및 학생이 주를 이루고 있다. 저작권법의 궁극적 목적인 ‘문화의 향상발전’과 도서관법이 ‘국가 및 사회의 문화발전에 이바지함’을 목적으로 하는 것을 볼 때 저작권법과 도서관이 도달하고자 하는 바는 ‘문화의 발전’에 기여하는 것으로 같다고 생각된다.
    따라서 도서관은 저작권법이 도서관을 구속하고 속박하며, 이용자들을 불편하게 하기 위하여 존재하는 것이 아니라, 도서관이 지향하고 있는 국가ㆍ사회의 문화발전을 촉진한다는 사실을 이해하도록 노력 하여야 한다. 그리고 도서관이 저작권을 충실히 보호하는 실천을 해나가면서 도서관에 불합리하거나 보완이 필요한 부분에 대하여 바로 잡으려는 노력을 하는 것이 합리적이라고 생각한다. 이러한 노력이 도서관 이용자를 진정으로 보호한다는 것을 이해하고 존중하는 날이 되면 도서관의 서가는 풍요로운 창작물로 가득차고, 도서관이 문화의 향상 발전을 향유하고 자극하는 지혜의 등대로 거듭 태어날 것이라고 생각한다.

    This study examined the use of copyrighted products at university libraries and the Copyright Law article 31, 'Reproduction in Libraries, etc.', Out of the limitation to authors' property rights.
    Out of various kinds of libraries, especially university libraries not only play a central role in distributing academic information, but get involved in productions such as establishing the database of theses for academic degrees. Accordingly, university libraries are directly applied to by the whole provision regarding 'Reproduction in Libraries, etc.' and related to the Copyright Law article 25, 'Reproduction for the Purpose of School Education'
    In 2000, electronic library-related regulations were newly enacted in Amended Copyright Law, but there were a great many of controversies about the digitalization and transmission of data possessed by libraries, and since 2003 when another electronic library-related regulations were newly enacted to a considerable extent in Amended Copyright Law, the present Copyright law has been maintained as it is today with new concepts and institutions introduced such as Compensation System for Libraries. As a result, There has risen a necessity that university libraries should grasp how the newly amended copyright law is applied to the use of Works at university libraries. Therefore, in the viewpoints of librarians working at university libraries, it was intended that the services for users at university libraries could be helped through this study.
    On the basis of the investigation into the use of Works at university libraries and the application of the Copyright Law article 31 in connection with the Copyright Law article 25, 'Reproduction for the Purpose of School Education' and the Copyright Law article 30, 'Reproduction for Private Use', in that university libraries are established at educational organizations, the results of the study can be summarized as follows:
    Firstly, admitting the public good of libraries, Copyright limits Authors' duplication and transmission rights and so on under particular conditions for the use of Works at university libraries. Accordingly, it was found that the use of copyrighted materials should be carefully done within the conditions of immunity allowed by Copyright Law in using Works at university libraries. Especially, it is needed for each library to take a leading role in managing copy services.
    Secondly, with the results of investigating the conditions of immunity and their allowable extents stated in the Copyright Law article 31, 'Reproduction in Libraries, etc.', in order for library users to be provided with duplicated materials they demand, university libraries are supposed to provide each user asking for the material with 1 copy by copying part of the data, which means they are not allowed to either hand out 1 copy to each of a number of students at the same time or provide one student with more than 1 copy. In case that digital data should be transmitted to another library, since compensation for libraries should be paid, it is required for university libraries to grasp and manage the data needing a permission to use and the data available for free uses separatively.
    Thirdly, as for the use of Works and the applications of Copyright Law, perusal service, copying, duplication service and interlibrary loan service and so on were examined out of all the services offered by university libraries, and as for the perusal of digital data, the right of public performance and the right of broadcasting are related, and temporary data storages taking place in the occasions were comprehended not to come under duplication.
    Moreover, it was investigated that parts of Works in the copy service should be provided less than one third of the whole, and the transmission taking place in using Fax and Ariel system used in the interlibrary loan service is not included in Transmission of Copyright Law since it is regarded as a temporary storage taking place additionally according to the delivery of analog data.
    Fourthly, in reference to copying Service at university libraries in which organizations such as Authors' groups have lots of interests due to illegal duplication-related problems, there are a number of parts handled beyond the extents allowed by the conditions of immunity stated in the 31st Provision of Copyright Law in the administration of duplication machinery and tools in libraries, so that it is required to make copy services of university libraries improved as soon as possible.
    It is considered that university libraries are in dual-positions of playing roles as a library and an educational organization, and users of university libraries mainly consists of the faculty members and students of educational organizations as well. On the basis of the facts that the ultimate goal of Copyright Law is 'The Improvement and Development of Culture' and the purpose of Library Law is ' Contributing to the Cultural Development of the Nation and Society', it is considered what Copyright Law and Library Law intend to accomplish is like contributing to 'The Development of Culture'.
    Accordingly, libraries should understand the fact that Copyright Law exists not to restrict or restrain libraries, making users feel uncomfortable, but promote the cultural development of the nation and society that every library intends to pursue. Besides, it is considered that it is reasonable for libraries to make efforts to correct the parts unreasonable or needed to be complemented while making a practice of protecting copyrights faithfully. By the time when such an effort is understood and respected in protecting library users genuinely, it is anticipated that the bookshelves will be filled with a variety of products of creativity while libraries will turn into a lighthouse of wisdom stimulating and contributing to the improvement and development of culture.
