The project of reexamination of land registers is an indispensible national project which can readjust the differences between the real land situations and the official registers. In this project, however, many disputes about the boundary between real estates can appear, and the settlements of those disputes are not easy. That's why we have difficulty in promoting the project.
Recently the disputes have been the focus of public interest, and this article aims to encourage reexamination of land registers by examining the disputes about real estates' boundaries due to the project from various view points of public law. The basic critical mind I have is that as long as the project has the nature of public interest, the disputes out of the project should not be considered merely as civil matters. That is, it is necessary that public organs should intervene in the disputes as far as the disputes has public colors.
In the chapter II, I examine the legal significance of land register system, the concept of reexamination of land registers, legal grounds of the reexamination, foreign reexamination system, and legislative process of the project of the reexamination.
In the chapter III, I examine the disputes about the boundaries arising out of the project, which have been the main issue around the project, and the causes of the disputes. In addition, I try to present reasonable solutions to settle those disputes. For the purpose, I examine the types, the cases and judicial precedents of the disputes, and on the basis of this examination, also examine some critical factors causing disputes in the future projects to present policy alternatives to prevent those disputes.
In the chapter IV, I analyze the issues of public law about the disputes mentioned in the chapter III. The analyses include administrative supplement system as a post-factum remedy in administrative remedy acts, and administrative suits for the settlements of the disputes. Furthermore I also analyze constitutional lawsuits as a solution around the issues related to the changes of boundaries and sizes of the lands arising from the project.
In the chapter V, I present the orientation for settlements of the disputes on the basis of the examinations and analyses in the chapter III and IV.
As a result of my examination of the issues of public law around infringement of rights of land owners due to the project, the claims for damages out of differences of registers can be settled by special provision of negligence. In addition, the certain degrees of property damages of land owners out of the project can be within the social restriction provided in the article of 23 ② of Constitution, where the restriction is considered as legitimate. Nevertheless, the legitimacy doesn't exempt the government from legislating the act to compensate the damages of land owners. In some cases, there appear illegality of negligence to legislate. In conclusion, the government should sooner or later take certain steps to solve the problems out of the differences of the registers and to establish an advanced land register system. In the course of those steps, I hope this article to be of a little help.
