Under the presidential system like our country, in which the President shall be the Head of State being vested executive power, the presidential records are the archives that possess very important values even in a historical perspective together with its administrative values. However, in spite of its importance, the presidential records have not been created properly amid our modern history that has been developed in a disrupted fashion. Although the presidential records were created and filed, most of them were leaked or disposed at personal discretion or have had been vanished or lost, so that the presidential records were not able to be transferred in a righteous manner after the end of the administration.
As a result, the records of all the successive Presidents that must be preserved at the level of nations have been remained insignificant in both quantitative and qualitative aspect. Against this backdrop, the requests of every segment of society for professional managements of the presidential records according to improvement of citizens’ consciousness of the management of the presidential records had made, so then in 1999, 「Act on the Management of Archives by Public Agency」was enacted, with clear statement of d public ownership of the records. In 2007, our society had reached a stage so much as to pursue a systematic management and changes of the legal ownership of the official records of the president from private to public through enactment of 「Presidential Records Management Act.」
Through establishment of such new statutory structure, a foundation was laid for preparing thorough protective measures for all presidential records together with stipulations for mandatory creation and preservation of the records, and also having prepared a legal basis for establishment of Presidential Archives and Records Administration, the Presidential Archives and Records Administration got started its operation within the National Archives of Korea, Seongnam Branch. Owing to such measures, it is expected that the presidential records, which have been kept by the National Archives of Korea so far will be managed professionally by the Presidential Archives and Records Administration.
In this paper, researcher has carefully examined the entire process and procedures relative to the presidential records, including collection, transfer, arrangement, preservation, and utilization thereof based on literature review and case study through internet websites, having considered that preservation and management of the records are also important together with securing public ownership of the presidential records amid expectation of increased use of the presidential records following enactment of 「Presidential Records Management Act.」as well as establishment of the Presidential Archives and Records Administration.
In the first place, the basic concepts and characteristics of the presidential records were defined, having referred to the laws of our country and the statutes of the United States as well related to the presidential records. Also the researcher investigated the current system associated with the presidential records of our country. In addition, the related procedures to receipt, including collection and transfer of the presidential records, and the activities in order to preserve and manage the records after receiving it, as well as to utilize this information in a more affirmative manner, the researcher conducted researches with a focus on its process.
However, there are limits in this research, in that the researcher didn’t treat the detailed contents in depth according to each step in the course of dealing with entire process of the managements of the presidential records, not as in a part thereof, and even that the process having been dealt with was merely theory oriented, not outcome which was obtained by having applied the process actually to the presidential records. And, for the records of the former president, Roh Moo-hyun, which are most up-to-date, and enormous amount of records have remained as in the stage of arrangement yet, the researcher was unable to utilize such records as research materials or resources, so then, this may be considered a weak point in this paper. Thus, it is required to pursue researches further from the perspective of more practicable way.

국문 초록 (Abstract)

우리나라는 1948년 정부 수립 이후 1960년대 초 한 차례의 내각 책임제 기간을 제외하고 지속적으로 대통령중심제를 이어가고 있다.
대통령이 국가의 대표이자 국정 책임자인 대통령중심제 상황에서, 대통령의 국정운영과정 중 생산․접수된 대통령기록물은 국가의 주요 정책 결정과정 등을 포함하고 있어 행정적 가치와 함께 역사적으로도 중요한 가치를 지니는 기록물이다.
그러나 우리나라의 대통령기록물은 그 중요성에도 불구하고 파행적으로 전개된 현대사 속에서 정치적 이유 등으로 제대로 생산하지도 않았고, 생산된 기록 역시 대부분 개인적 유출 또는 폐기, 유실 되어 임기가 끝난 후 제대로 이관되지 못했다.
결과적으로 국가차원에서 보존되는 역대 대통령의 기록은 양적으로나 질적으로나 미미한 수준에 머물게 된 것이다. 이에 기록관리에 대한 국민적 의식 향상과 함께 대통령기록물의 전문적인 관리에 대한 사회 각계각층의 요구가 표출되어, 1999년에는「공공기관의기록물관리에관한법률」이 제정되어 대통령기록물에 대한 국가소유를 명백히 하고, 2007년에는「대통령기록물관리에관한법률」의 제정을 통해 대통령기록의 체계적 관리와 사회화를 적극적으로 시도하기에 이르렀다.
이러한 법률들의 제정을 통해 대통령기록물에 대한 생산 및 보존 의무와 함께 철저한 보호조치에 대한 근거가 마련되었고, 또한 대통령기록관 설립에 대한 법적 근거의 마련으로, 국가기록원 성남지원 내에 대통령기록관이 운영되기 시작하였다. 이로 인해 지금까지 국가기록원에서 관리되어 왔던 대통령기록물을 곧 대통령기록관에서 전문적으로 관리할 것으로 예상된다.
본 논문에서는「대통령기록물관리에관한법률」의 제정과 대통령기록관이 설립됨에 따라 대통령기록물의 이용이 증가할 것이라 예상되는 가운데, 대통령기록물에 대한 공적 소유권을 확보하는 것과 함께 보존하고 관리하는 일 역시 중요하다고 보고, 대통령기록물이 수집, 이관, 정리, 보존, 활용되는 전 과정을 문헌조사와 인터넷 홈페이지를 통한 사례 조사 등을 위주로 살펴본다.
우선 대통령 기록물에 대한 기본적인 개념과 특징을 우리나라의 대통령기록물 관련 법률과 미국의 법령 등을 통해 살펴보고, 우리나라 대통령기록물 관리에 대한 현행 제도를 살펴본다. 이어서 대통령기록물의 수집과 이관 등 입수와 관련된 과정과 입수 후 기록물을 체계적으로 보존․관리하고, 적극적인 활용을 위한 활동에 대해 알아본다.
