海外不動産 投資에 관한 硏究 = A Study on the Investment to the Foreign Real Estate

영문초록:The foreign real estate investment has been strictly regulated by the Korean government until recent time. The globalization and change in the circumstances of the world economy, however, is now making the government encourage and develop this area. At this point, scientific and systemized studies of the effective access to the foreign real estate market is required to find the best way to make possible the reduction of the probability of failure in the foreign real estate investment. Although the investors have to go through a long and complicated investment path in the foreign real estate investment and there are lots of issues and problems to be solved during this process, it is so difficult for the investors to have an opportunity to invest in comfort to the foreign real estate because our real estate industry has not yet developed a comprehensive system to fully cover all the issues and problems through the path.For the safe and successful investment to the foreign real estate, the investment path should be firmly established from the stage of having investment intention to the transaction closing (or to the sale of the purchased property as the case may be). In this regard, the U. S. A. is the country fit for the first one to which the investment path needs to be established in that the U. S. A., one of the most developed country, has an advanced real estate industry and system, exercises a big influence on the international market and makes its industrial standards global ones. In addition, it is one of the countries where Korean people have most interest in investment to the real estate.To establish a good investment path, Korean government should make an effort to improve and develop investment programs, and the investors and the real estate industry should set up a legal and reasonable investment practice. It is also required to build up the legal and industrial infrastructure to ensure safe investment by providing comprehensive service based on specialties in all the areas of real estate industry, understanding of the invested country, language proficiency and the ability to carry out international business.It is also good for the development of this industrial area to set up an association of the people working in this area and an institution for practical training. The best solution, among others, would be to make a full coverage one-stop consulting company which can provide all investors with any service required through all the path from the stage of having investment intention to the transaction closing (or to the sale of the purchased property as the case may be). To make this possible, the company has to be composed of the specialists in real estate, foreign relations, language, the invested country and related industries. It should be equipped with a system on which it can find clients in necessity of assistance, for example, the franchise network of most of the real estate agents around Korea. It also have a good relation with domestic cooperators such as immigration service companies, diplomatic and consular organizations, banks and other specialists involved in real estate. It should manage adequately all the process in the invested country and play a role to liaise the investors to the local specialists by making a business cooperation relationship with them. Services such as taking care of administrative works during the occupation, managing the property and supporting re-investment of the proceeds from the property sold should also be available at the request of the clients.The parts of the investment path gone through in Korea are basically all the same and the parts of path in the invested countries are not much different country by country wherever we invest. If the investment path to the U. S. real estate is established in such a way, therefore, it would be easier to expand the countries to which we establish the real estate investment path based on the U. S. path
