One of the things occupying the biggest part of our lives is the real estate. The real state brokerage business may be mentioned as the area whose importance has been essentially increased in accordance with the increased activities in the real estate. It is considered that the subject having duties to supply these services for real estate and to protect the property rights is the very licensed real estate agent. Of course, there may be engaged workers in other forms in relation to the real estate. However, we, who are living in the ceaselessly changing era and in the era of segmentation and specialization, can not help acknowledging the objective abilities of performing their duties of workers by each field. The person having the qualification on these objective abilities of performing duties based on the formalized criteria is the licensed real estate agent.
However, the status of licensed real estate agent is being shaken. Internally, the licensed real estate agent system was not in a state of settlement yet since this system has been introduced due to the unpreparedness of the licensed real estate agent system and the lack of real estate distribution policies, etc. The problem of controlling demand and supply is being reached at a saturation situation due to the excessive appearing of licensed real estate agents without any measures, and this makes the status of qualification system returned to the state before performing the qualification test system. As ever, a good many holders of certificates of qualification for the licensed real estate agents are keeping their certificates as wardrobe licenses, and even in case of the opening their own businesses, most of them are license holders who are genuine laymen at the practical affairs, and the licensed real estate agents having experiences at practical affairs also are facing with great predicaments numerously in the fields having no prepared knowledge, i.e., not contained in the contents of test.
Moreover, the reliability of the nationals was being deteriorated due to the intentional exposure and announcement on the unlawful acts, etc. of licensed real estate agents because of the repetition of guidance and enforcement of the government to impute some responsibilities for failures in the real estate policy to the licensed real estate agents, and the status of qualification system is being shaken due to the excessive appearing of licensed real estate agents without any measures, and the expertise is being deteriorated, and the right to live as well as stable management also is being affected significantly due to the excessive competition among agents accordingly. Besides, it is the actual circumstances that the entry of the relevant specialized certificate holders into the real estate brokerage business has torn down the unique work area of the licensed real estate agents.
Externally, since the entry of various foreign firms having tremendous financial abilities and advanced and specialized techniques into Korea has been accelerated because the real estate market was also opened due to the advent of economic order by neoliberalism such as market-opening and mitigation of regulations, even the rights to live of the licensed real estate agents have been threatened accordingly.
It is considered that the current licensed real estate agent system is very insufficient to cope with these internal?external situations in the specialty as well as in the aspects of practical affairs.
The purpose of this study is to present the problems based on the analysis on the test system for licensed real estate agents to cope with the changes and crisis, and to present practicable alternatives by finding out the plan for improvement after examining, comparing and reviewing test systems for licensed real estate agents among Korea and foreign countries.
For this purpose, in chapter 1 as an introduction, the justifiability of this study was presented by raising the issues, by revealing backgrounds and purposes of the study and the methods and scope, and in chapter 2 as the close examination on the general theory for the licensed real estate agent system, the licensed real estate agent systems of foreign countries along with the basic theoretical close examination were reviewed, and their features and suggestions were drawn.
The plan for improvement stated in chapter 4 was drawn by reviewing the present situation and problems of the licensed real estate agent system in Korea stated in chapter 3, and in chapter 5 as the conclusion, my opinion through this study was presented.
The pitiable and inconvenient thing while performing this study is the fact that the findings beyond expectations has not been accomplished due to the insufficiency of performing time for the study and the shortage in the data on preceding studies for this part. However, it is my earnest hope that the more advanced and developing discussion may be achieved in this field in the future on the basis of the data presented in this study.
