Recently, the interest of defectionist from North Korea staying in foreign countries has elevated worldwide. They have been getting attention from the world media already in mid 1990''s when their provision of food was in difficulty. Nowadays, the United States of America is connecting the North Korean human right problems, and formally acknowledge defectionist of North Korea as political exile. Allowing them into the U.S. suddenly rose their existence. Allowing the defectionist''s into the nation is the same as defectionist''s human rights in the past, returning to South Korea permission problems or sending them back is a totally different matter. That why the U.S. made the North Korea''s decisive weak point a worldwide issue, which is cracking down on their human rights. Including the United Nations, other countries around the world, see the Kim Jeong Ill government very anti-humanity for cracking down on the people of North Korea. Not only that creating a worldwide sympathy, that unmorality government, against North Korea, also, can insure ethical justification against North Korea''s chastisement. North Korea making an attempt to develope nuclear weapons and long distance missiles as self-defense complementary measures. Targeting the U.S., Japan and South Korea, after executing public military threat. It is the most effective measure and negotiable card to cut of the North Korea''s attempt on accomplishing diplomatic and economic Big Deal. Also set up a unsettled mentality among the defectionist''s to contact detonation collaspe of Kim Jeong Ill''s structure. Not only that, Al Qaida, the cause of 9.11, and international terrorist organization and due to the link of warfare supported by Afghanistan and Iraq force of arms invasion, the international human rights justification is predicament. It seems as the United States allowing defectionist''s into it''s nation, trying to upgrade the human rights image seems to be the objective.
Therefore, such America''s intention following the North Korea''s ''human rights oppression'' problem is the most distinct way to emboss the actual example, making good use of the defectionist.

Therefore the continuous reinforcement pressure on self-defense, the United States, defectionist''s staying aborad exiling them to the U.S. Gradually the scale will become a giant scale. So, the diplomatic friction between North Korea, China and South Korea will become inevitable. The reason is that, North Korea''s defectionist will flee to the United States. They could show sensitive reaction against slender aimed at the North Korea''s government through the apparatus of the party, human rights organization or through the press. Not only that it is foresighted that possibility of kidnapping the North Koreans can cause a friction with the U.S. Also, China a country where a lot of the defectionist stay, despite of the international criticism, China was arresting and sending defectionist back to North Korea. But this time allowing the defectionist to exile to America, the possibility of deplomatic friction against the U.S. seems to be greater. Also on the South Korea''s side, the measure the U.S. took was not only for defectionist''s staying in China or other nations but, also for defectionist''s who already settled down in South Korea. Previously, a defectionist got an allowance to defect in South Korea, while obtaining a citizenship, So Jae Seok, political oppression cause him to become a U.S. citizen. Cause of the case that happened the international authority saw South Korea''s human rights nation as a down fall. There could be friction with the U.S. for not being able to do a good job in exercising the nations sovereignty which is the duty of protecting and legal rights of the nations people. Besides, part of the people who settled down, are trying to defect to Japan or the U.S. for it''s better development in capitalism. Hereafter, the possibility of defectionist staying in foreign countries, would rather defect to the U.S. or a 3rd nations without any gristle. Therefore the South Korean government is requested to come up with a fundamental measure.



Due to these reasons, defectionist''s staying in foreign countries willing to defect to South Korea or people defecting from North to South, the international environment surrounding the South Korea''s policy on defectionist, will have to be improved. Before defectionist''s applying to defect to South Korea, only had to have a interview, or better yet just allowed them to come in without any special reason. But now if the U.S. offer the defectionist a better condition than the South, it is highly possible to lose the high class information about the North. Because the U.S. are taking all the defectionist to it''s own nation, who have high class information about the North.

Therefore this essay is about how we can support the defectionist''s coming into South Korea and compete against the United States over good service for the North Korean defectionist. Looking at it in a dimension of nations people enforcing tax. Certainly, pervious South Koreans pointed out a sentimental agreement on systematic device must be presented. Also not letting any defectionist''s into South Korea but putting up a more difficult examination and letting in only those who pass the examination. Not letting in people, who were on drugs or have a record of crime. And fully understanding the cause of defectionist, and grasp rather they want to stay in or out. Also when letting them stay in South Korea, it is important to improve any illogical, uneffective systems against the defectionist. Always have to check up on the people who are already living inside about why they are not capable of adjusting to Korea. It is suggested there should be programs built to complement them by the government, nations party and social party. With these programs there should be cases where the defectionist show that they are adjusting well to South Korea. It is emphasized that Koreans should make a harmony and should be given a condition to adjust and live well.

국문 초록 (Abstract)

최근 북한을 탈북하여 해외에 체류중인 탈북자들에 대한 전 세계적인 관심이 높아지고 있다. 그들이 세계 언론의 주목을 받았던 것은 이미 북한의 식량난이 심각했던 1990년대 중반부터 시작되었지만, 요즘은 대북 인권 개선 문제와 연계하여 미국이 북한 탈북자들을 정치적 망명자로 공식 인정하고 미국으로 받아들이기 시작하면서 이들의 존재가 새삼스레 부각되기 시작하였다. 미국이 탈북자들을 미국내 영토로 수용한다는 것은 과거 해외 체류중인 탈북자들의 인권 문제나, 한국으로의 귀순 허용 문제, 체류 국가측의 탈북자 북한 강제송환 문제 등이 이슈가 되던 사항과는 전혀 다른 의미를 갖고 있다. 그것은 미국이 북한측의 결정적인 약점중의 하나인 ‘인권 탄압 문제’를 국제적으로 이슈화하여 UN을 비롯한 세계의 여러 국가들로부터 북한의 김정일 정권이 독재정권으로 주민들의 인권을 탄압하는 매우 반인륜적이고, 부도덕한 정권이라는 것을 전 세계에 널리 알려 공감대를 형성하여 북한에 대한 전방위 압력을 가하기 위함이다. 이와 동시에 북한에 대한 응징의 윤리적 정당성을 확보할 수 있으며, 북한이 자위적 방어조치라는 명분으로 핵무기와 장거리 미사일 개발을 시도하면서 미국과 일본, 한국 등을 대상으로 하는 군사적 협박행위를 공공연하게 실시한 후, 이들 국가들과 외교적?경제적 빅딜(Big Deal)을 성사시키려는 북한의 시도를 사전 차단할 수 있는 가장 효과적인 수단과 협상 카드가 될 수 있다. 그리고, 탈북자를 중심으로 북한인들에 대한 심리적 동요를 불러 일으켜 궁극적으로 북한 김정일 체제의 붕괴를 촉발시킬 수 있다. 또한, 미국이 9. 11 테러를 일으킨 알 카에다 등 국제적 테러 조직과의 전쟁 수행의 일환으로 테러 조직을 지원하는 아프가니스탄과 이라크 무력 침공으로 인해 국제적 인권 문제에 대한 명분 상실로 궁지에 처해있던 미국이 북한 탈북자들을 자국내로 수용하면서 국제 인권 문제에 적극 개입하여 인권 국가로서의 이미지 개선 효과를 거둘 수 있는 다양한 목적과 배경 때문에 북한에 대한 ‘인권 탄압’ 문제를 제기한 것으로 판단된다.



미국측의 의도에 따라 북한의 ‘인권 탄압’ 문제를 가장 극명하게 부각시킬 수 있는 실증적 사례로 탈북자들을 적극 활용하고 있는 것으로 보이며, 이에 따라 북한에 대한 지속적인 전방위 압력 강화를 위해서도 미국은 해외에 체류중인 탈북자들을 미국으로 망명 수용할 것이며, 점차 그 규모도 대규모화될 수 있을 것이다. 이로 인해 북한과 중국 그리고 한국 등과도 외교적 마찰이 불가피해질 것이다. 그 이유는 북한은 북한 국적의 탈북자들이 미국으로 망명하고, 이들이 각종 기관이나 인권단체, 언론 등에서 증언을 통한 북한 정권 비방 행위를 전개하는 사항에 대해 민감한 반응을 보일 수 있으며, 북한인에 대한 납치 주장까지도 가능할 것으로 보여 미국과의 마찰이 예견된다. 또한, 중국은 탈북자들이 주로 체류하는 국가로서 국제적인 비난에도 불구하고 북한과의 협약에 따라 탈북자들을 체포하여 북한으로 강제송환하였으나, 금번 미국측의 망명 허용 조치로 인해 탈북자 처리 문제에 대해 미국과 직?간접적인 외교적 마찰이 발생할 가능성이 높은 상황이다. 그리고, 한국측에서는 미국측의 조치가 중국 등 제3국에 체류하는 탈북자들뿐만 아니라, 이미 한국에 정착한 새터민들까지도 동요하게 만들고 있어 기존에 한국으로 귀순이 허용되어 한국인 국적을 취득하여 정착중이던 새터민중 서재석씨가 한국에서의 정치적 탄압을 사유로 재차 미국행이 허용되는 사례가 발생하면서 한국에 대한 인권 국가로서의 국제적 위신이 추락하게 되었고, 자국민 보호 의무와 권리에 대한 국가 주권을 제대로 행사하지 못한다는 점에서 미국과의 외교적 마찰이 생길 수 있다. 또한, 이미 한국에 정착한 새터민 일부 인원중에서는 한국보다 자본주의가 더 발달된 미국이나 일본 등으로 재차 망명을 시도하려는 심리적 동요가 발생되고 있는 실정이며, 향후 해외에서 체류하던 탈북자들도 한국으로 귀순하기 보다는 미국 등 연고지가 전혀없는 낯선 제3의 국가들로 망명의 다변화를 꾀할 가능성이 높아 이에 대한 한국 정부의 근본적 대책이 매우 절실하게 요구되고 있는 상황이다.
