청소년범죄의 예방에 관한 연구 = A Study on the Prevention of Youth Crime

국문 초록 (Abstract)

한글초록: 이 연구는 청소년범죄의 실상을 정확히 파악하고 청소년범죄의 원인을 분석한 다음 그 결과를 토대로 청소년범죄의 예방책을 제시하는 것을 목적으로 한다. 청소년범죄는 그 자체로서도 중요한 의미를 갖는 것이지만, 더 나아가 청소년범죄가 미래의 성인범죄로 발전할 가능성이 크다는 점에 문제의 심각성이 있다. 그러므로 청소년범죄 예방의 문제는 비단 오늘의 예방에 그치는 문제가 아니라 미래의 성인범죄를 예방하는 문제도 된다는 점에서 더욱 중요한 의미를 갖는다. 한편 청소년들은 성인들에 비하여 심성이 순수하고 감성이 풍부하여 쉽게 감동하는 성향이 있어서 그들에 대하여 적절한 교정교육이 이루어질 경우에는 쉽게 개선되고 건전하게 성장할 가능성이 크다. 그렇기 때문에 청소년에 대한 형사정책에 있어서는 성인의 경우에 비하여 교정교육이 훨씬 중요하다고 여겨지는 것이다. 이 연구는 제1장에서 제5장까지 모두 5개 장으로 이루어진다. 먼저 제1장에서는 연구의 목적, 연구의 범위와 방법을 살펴본다. 제2장에서는 청소년범죄에 관한 일반적인 사항을 검토하는데, 청소년범죄의 개념과 범위, 청소년범죄의 원인, 범죄원인으로서의 소질과 환경, 청소년범죄의 대책 등이 주된 내용을 이룬다. 제3장에서는 환경개선에 의한 청소년범죄의 예방에 관하여 살펴보는데, 가정환경․학교환경․사회환경 등에 관하여 각 그 현황을 검토하고 개선방안을 제시한다. 제4장에서는 제도개선에 의한 청소년범죄의 예방에 관하여 살펴보는데, 수사기관의 청소년범죄 예방제도, 법원 및 재판부의 구성, 시설내 처우 및 사회내 처우의 내용, 청소년문제를 담당하는 행정기관 및 교정기관 등의 현황을 검토하고 그 개선방안을 제시한다. 제5장 결론에서는 청소년범죄의 예방을 위하여 기성세대가 해야 할 가장 중요한 일은 지난날의 불건전했던 생활을 반성하고 청소년들에게 모범이 되는 삶을 살아가는 것이라는 점을 강조한다. 청소년범죄의 근원적인 해결을 위해서는 가정․학교․사회가 모두 청소년문제에 대하여 막중한 책임감을 느끼고 청소년범죄를 유발하는 원인을 제거해야 하며, 나아가 극도로 훼손된 윤리관과 가치관의 재정립을 위하여 힘써야 한다. 기성세대는 청소년의 사고와 행동양식을 이해하고 기성세대와 청소년 세대가 조화를 이루며 더불어 살아가는 방법을 찾아야 한다. “좋은 나무는 좋은 열매를 맺고 나쁜 열매는 나쁜 열매를 맺는다.”

국문 초록 (Abstract)

영문초록: This thesis aims to examine recent patterns of the youth crime, investigate its prime factors, and suggest feasible solutions to prevent the crime in Korea. While the youth crime itself has such significance, its real seriousness lies in the fact that juvenile offenders are likely to become adult criminals in the near future. Therefore, preventing the juvenile crime restricts both today's juvenile delinquents and tomorrow's adult crimes. Because juveniles generally are more genuine and sensitive than adults, when properly educated with correctional programs, they show more improvements than adults. Thus, the correctional program is heavily emphasized in juvenile criminal policy. This thesis consists of five chapters. Chapter One describes the purpose, extent and method of the study. Chapter Two closely examines general matters related to youth crime: its concept, extent, cause and the cause's nature and environment and finally, ways to prevent it. Chapter Three studies recent conditions of juvenile's environmental surroundings - family, school and society - and suggests preventive measures through improving the surroundings. Chapter Four seeks to prevent youth crime through the institutional improvement of investigational institutions, the formation of courts, the contents of the treatment within the institution and the community, and the current conditions of the administrative or correctional organizations. Chapter Five, the last chapter, summarizes the thesis and stresses that the most important role of the elder generation is to reflect on their unhealthy acts in the past and set a good example of healthy living for the younger generation. To provide the fundamental solution for the problem of youth crime, family members, schools, and society must admit their intense responsibility towards the juvenile, eradicate sources of the crime, and strive strenuously to reconstruct the juveniles corrupted values and ethics. We, the elder generation, should understand the thought and behavior of the younger generation and seek the solutions to live together in harmony. Guiding our younger generation to the right path is the elder generation's precious duty. May we never forget that youths are products of the seeds we sowed. "A good tree bears good fruit, but a bad tree bears bad fruit."
