정권교체에 따른 경찰제도 변화의 유형에 관한 연구 : 신제도주의의 경로의존성 이론을 중심으로

국문 초록 (Abstract)

본 논문은 국가정권의 교체에 따라 경찰제도가 어떠한 억압성의 형태(patterns)를 가지며, 이것들의 경로의존성 유형(path-dependency types)은 무엇인지를 연구하고 있다. 논문의 요지는 다음과 같다.
첫째, 기존의 법제적인 경찰제도연구가 갖는 정태적인 연구방법을 극복하고 신제도주의(new institutionalism) 이론, 국가론 및 정치경제학을 절충하는 동태적인 방법을 취하였다.
둘째, 역사적 제도주의(historical institutionalism)의 기본주제인 ‘역사가 문제된다 (history matters)’는 점을 경험적으로 사례분석하기 위하여 미군정으로 부터 김대중 정권까지를 사례대상으로 하였다.
셋째, 역대 한국경찰제도의 억압성이 가지는 경로의존성을 비교평가하기 위한 맵핑(mapping)작업에서 계량적인(quantitative) 기준과 해석적인(qualitative or interpretative) 기준을 상호보완적으로 사용하였다. 특히, 경찰제도의 억압성을 해석적으로 평가하기 위하여 병영적인 억압성, 이념적인 억압성, 규제적인 억압성, 그리고 행정적인 억압성으로 범주화하고 있다.
넷째, 한국경찰제도의 억압성이 갖는 경로의존성 유형은 기존이론인 ‘진화론적’(evolutional) 이론 및 ‘단절적’(punctuational) 이론으로는 설명하기 어려우며, 본 논문이 찾아낸 ‘일탈적 경로의존성 유형’즉, ‘군사 권위주의화 일탈’ 및 ‘민주화일탈’ 유형이 보다 적실성이 있다고 주장한다.
결론적으로, 본 논문의 가설적인 명제들은 상당히 적실성이 있음을 입증하였다.

다국어 초록 (Multilingual Abstract)

This thesis examines how repressive patterns of the　Korean police institution vary with the state regime changes and what path-dependency types they have.
First, in this study, the author goes beyond the prevailing legalistic studies of the police institution, then, takes a dynamic approach, combining the new institutionalism, the state theory, and political economy approach.
Second, the case study ranges from the U.S. military government to the Kim Dae-Jung administration for a historical analysis of police institutions: 'history matters.'
Third, quantitative and qualitative or interpretative criteria are used complementarily in mapping to conduct a comparative appreciation of repressive patterns which each regime's police institutions took. Especially, state's repressive features are categorized into military, ideological, regulatory, and administrative aspects.
Fourth, it is hard to explain the path-dependency types of suppression that Korean police institutions have in the view of the prevailing 'evolutionary' and 'punctuated equilibrium' theories, therefore, this study find out an alternative explanation: 'military authoritarian-deviation' and 'democratization-deviation' types of path-dependency.
In conclusion, it is demonstrated that hypothetical propositions in this thesis are highly feasible and relevant.
