송전선로 건설에 따른 전자파 분쟁과 환경법의 역할 = The Role of Environmental Law in Dealing with Conflict surrounding the Building of Transmission Lines

다국어 초록 (Multilingual Abstract)

The conflict surrounding the building of high voltage transmission lines in Miryang has caused an uproar in society recently. There have been continuous cases where local people have raised questions about the health impacts from the transmission line`s electromagnetic field(hereinafter referred to as “EMF”). What is the role of environmental law in dealing with conflict on the EMF? This study tried to analyze environmental law with tools of risk assessment, risk management and risk communication, that may be applicable to the conflict on the EMF, focusing on risk assessment of environmental factors, environmental impact assessment system and environmental dispute adjustment system, in order to show ways to improve current environmental law in dealing with EMF disputes Based these analyses, this study presented some concrete ways to improve our environmental law: First, wider environmental factors including EMF should be subject to risk assessment; Second, reasonable legal requirements should be established based on risk assessment; Third, transparency should be ensured in the decision process through improving environmental impact assessment system; Fourth, environmental dispute adjustment system should be applicable to EMF disputes, and administrative or financial supports to the local people should be institutionalized; Finally, EMF risk communication should be enhanced.
