특허의 질적 가치: 우리나라 특허권에 대한 집합적 특성 분석을 중심으로 = The Quality of Patents: An Multilateral Evaluation for Korea

국문 초록 (Abstract)

최근 우리나라에서 특허출원수가 양적으로 크게 증가하는 상황에서 본 연구는 국가 전반적인 차원에서 특허의 질적 측면을 분석한다. 이를 위해 먼저 특허의 질적 가치를 판단할 수 있는 기준을 제시하고, 이에 따라 특허출원단계별로측정지표들을 소개한다. 다음에 이를 토대로 가용한 자료들을 동원하여 우리나라특허 질의 특성을 평가한다. 연구결과 특허출원의 사내탈락률, 심사오류율, 특허허여율, 그리고 해외출원특허점유율 면에서는 특허의 질이 미국, 일본, 유럽 등다른 국가들에 비해서 크게 낮다고 볼 수 없다. 하지만 경쟁력 있는 분야로 여겨지는 정보통신기술 분야에서도 특허영향력이나 시장성이 미국, 유럽 등 다른 나라들에 비해서 미흡한 것으로 나타났다. 따라서 특허출원의 양적 성장보다는 질적 성장을 촉진하는 정책이 필요하다. 마지막으로 본 연구의 특허의 질 판단지표들은 특허의 사업화나 기술금융 분야에서 활용될 수 있으나, 보다 광범위하고 체계적인 방법론이나 지표개발이 필요하다.

다국어 초록 (Multilingual Abstract)

The number of patents application has sharply increased since the mid-1990s in Korea. The paper analyses the qualitative aspects of patents rather than the quantitative ones at the national level. We suggest the evaluation criteria of patents’ qualitative value, and introduce the measurement indexes reflecting the value according to the patent application process. Using these indexes, we evaluate the overall quality level of patents in Korea. We found that in terms of the error rate of screen, acceptance rate, and patents application to foreign countries,the patents quality level of Korea is not lower than that of the USA,Japan, and European countries. However, Korea should improve the indexes reflecting patents citation, for instance, patent impact index(PII)and patent market-powered index(PMI) for information and communication technology. Therefore, the Korean government should foster the quality of patents with inducing the quantity of patents.
Finally, although some indexes suggested in this study can be utilized in the process of commercialization and technology financing, more extensive and systematic methods or indexes should be developed.
