국제결혼중개업에 관한 법적 규제 = On Regulation of International Marriage Brokerage Business in Korea

국문 초록 (Abstract)

국제결혼 중개에 관한 법적 규제가 필요한 것은 부정할 수 없다. 계약법적 관점에서 소비자 보호라는 측면도 필요하지만, 그 보다 중개과정에서 발생하는 인권침해적인 요소를 방지해야 한다는 측면에서 필요하다. 현행 결혼중개업법은 불법적인 중개를 규율하기 보다는 인권침해적 요소가 많은 중개산업을 확대 재생산시킴으로써 불법한 상태에서의 결혼을 묵인하고 있다는 비판의 소지가 있다. 이러한 오명을 벗고 법의 실효성을 확보하기위해서는 결혼중개업법의 대상을 단순히 중개업자와 한국남성 사이의 계약관계로 파악할 것이 아니라, 상업주의를 바탕으로 수단과 방법을 가리지 않는 악덕중개업자들에 의해 피해를 받는 상대국 여성들을 보호하는 인권보호법으로서의 성격이 중심이 되어야 할 것이다. 또 국제결혼의 속성상 불법적 결혼중개행위가 외국에서 일어나는 경우가 대부분이다. 따라서 관련부처에서는 관련국가와의 협력을 통해서 외국 현지에서 이루어지고 있는 결혼중개실태를 면밀히 관리·감독해야 할 것이며, 법의 목적을 수행함에 충분한 담당인력의 확보, 관련부처간 업무협력, 관련국가간 협력체제 구축 등 관리감독기능의 강화가 전제되어야 할 것이다. 아울러 결혼 그 자체가 목적이 아닌 입국목적의 위장결혼을 미리막기 위해서는 국제결혼 과정에서 이를 판별할 수 있는 절차가 마련되어야 하고, 다른한편 취업을 목적으로 하는 입국을 가능한 범위에서 인정하는 것이 필요할 것이다. 요컨대, 국제결혼은 수요가 있으니 건전하게 발전하도록 해야 하고, 동시에 경제적 목적의 이민도 인정함으로써, 결혼이 그 수단으로 전락하는 것을 막아야 할 것이다. 이를 위해서는 국가간 공조가 필요하다. 국제결혼중개가 민간활동 중심으로 이루어질 수밖에 없고 또 그것은 최대한 보장되어야 하는 것이지만, 상업주의로만 무장된 결혼중개업체의 난립과 방종은 어떻게 해서라도 이를 막아야 할 것이다. 새로운 시각에서 공개적인 협력체제의 구축이 필요할 것이다.

다국어 초록 (Multilingual Abstract)

It is indispensible to regulate on international marriage brokerage in Korea. The regulation is required not only in terms of consumer protection from a contractual standpoint, but to protect their human rights which is susceptible to violation in process of brokerage. The Act on Regulation of Marriage Brokerage Agency is intended to guide and nurture the marriage brokerage business in a sound way and to protect its users in order to help establish a sound marriage culture, in which a person intending to engage in an international marriage brokerage business shall make a registration with the competent special metropolitan city mayor etc. of the area in which he/she wishes to open the brokerage office and the mayor and governor shall issue a registration certificate to a person who has completed the registration of an international marriage brokerage business are contained. But this Act is facing some heavy criticism, which could not regulate illegal brokerage, but encourage to expand reproduction violating human rights business and connivance at unlawful marriage ultimately. To take off the stigma of mentioned above and ensure legal effectiveness, we should not understand the relationship of a marriage brokerage business targeting people (Korean nationality and foreigner) as simple contracting parties. The Act should play an essential role to protect human rights including the other party`s women who suffer from evil marriage brokerage agencies.
