공공사업에 대한 갈등관리의 현황과 개선 방안에 관한 연구 = 철도 송ㆍ변전설비 건설 사업을 중심으로

Conflict Management(CM) of public works projects has recently been going on a projects having conflicts or its possibility under each subordinate agencies’s control in south korea. That reason is that CM has no specific context and clear enforcement standards because there is not to support current CM through legal system excepting a presidential decree. There is to progress legal system improved to solve the problems until now, but it failed because the bill has not been passed National Assembly. For this reason, current CM is going on a choice of enforcement authorities and its decision by arbitrary judgment is making a limitation of conflict managing.
It has effect to prevent some public conflicts which actually will be through CM although it was arbitrary. In fact, there is doubt to prevention in results which has no virtuous circle with the related system like using related data, post evaluation and project planning after.
The purpose of this study is to consider actual CM’s progress and its merits and demerits in public works projects and suggest improved methods, based on a awareness of current CM in south korea. However, it is difficult to analyze cases because there are not yet many cases, and some projects are needed security. Accordingly, this study is limited under ‘nationwide scale’, ‘same category’ and ‘continuous public projects in conflict managing now’. As a result of these, I suggests that Railway Projects of Transmission Lines and Substations(RPTLS) is suitable to analyze case of this study. Because this project already had a CM to two public projects which is ‘Honam High-speed RPTLS’ in 2009 and ‘Capital High-speed RPTLS’ in 2011. Also, in late 2012, the conflict management is making progress on Wonju-Gangneung RPTLS that is characterized by continuous CM in same category.
This study has the following significance. Firstly, this is first study to suggest performance and limitation of current CM on RPTLS. Secondly, this is meaningful as a overall evaluation result from each data and knowledge in research of each case. However, this study has limits on evaluation over internal CM because it is evaluated result from only RPTLS.
Therefore, it is necessary to study another CM’s cases, and each cases are researched, analyzed and evaluated. After this, I expects it will be managed totally, also CM’s actual plan will be provided through conflict assessment analyzed from each public works projects.
