북한 가족법의 공법적 특성: 수용한계의 측면에서 = The Characteristic as Public Law of North Korean Family Law: In the View of Acceptable Limit toward the Law of North Korea

다국어 초록 (Multilingual Abstract)

It is the most important point for us to comprehend the law of North Korea and to research about the difference and the similarity between the law of North Korea and South Korea as the matter of preparation for unification of Korea. Therefore, it is also important that to research the difference and the similarity between the law of North and South Korea in family law which controls the family relationship and to clarify acceptable limit of the difference to the law of North Korea. That is the main point of researching of the law of North Korea. In the case of North Korea, they have the characteristic that even the private relationship is regarded as the object of the sovereign power by the government, even though the civil law is typical private law which deals with private relationship. This is why North Korean family law has some kinds of characteristic of public law, that is based on not only the foundation theory of the construction of the great socialistic family(prescriptions 1 in the family law) and the prescriptions 54 which imposes criminal liability, but also administrative punishment. This is the main difference between the family law of South and North Korea.
