1990년대 말 평생교육법 제정 과정 분석을 통한 평생교육 개념 혼란의 기원과 논리 검토 = A Critical Review on the Origin and Logic of Conceptual Confusion of Lifelong Education through Analysing the Process of Enactment of Lifelong Education Act in the End of 1990s

국문 초록 (Abstract)

1990년대 말 ‘사회교육법’의 폐지와 ‘평생교육법’의 제정은 우리나라 학계와 현장에서 ‘사회교육’용어가 쇠퇴하고 ‘평생교육’ 용어가 이를 대체하는 중요한 계기가 되었다. 법 제정 당시 교육개혁위원회는 법 시안 작성차원에서 교육기본법과 같은 수준의 ‘평생학습법’을 제정하는 대신 교육기본법 하에 ‘사회교육법’을 ‘평생학습법’으로 확대 제정하는 방안을 채택하였고, 그 과정에서 법의 명칭과 내용 중에서 ‘사회교육’ 용어를 ‘평생교육’ 용어로 대체하였다. 그러나 다른 교육관계법과의 일관성을 추구하려는 정부 내 입장으로 인해 ‘평생학습법’의 명칭은 최종적으로 ‘평생교육법’으로 변경되었고 법의 영역과 위상도 위축되는 결과를 가져왔다. 그 결과 ‘평생학습법’을 통해 모든 교육을 포괄하는 명분도, 구 사회교육 영역을 모두 아우르는 법을 제정하는 실리도 제대로 얻지 못한 채, 이름을 ‘평생교육법’으로 바꾸고 법의 내용에서 ‘사회교육’을 ‘평생교육’으로 바꿈으로써 개념상의 혼란을 일으키게 되었던 것이다. 이는 당시 ‘평생학습’을 향한 확장적 관점과 ‘사회교육’에 대한 배제적 관점이 잘못 적용된 결과라고 볼 수 있다. 이러한 조치는 학계와 현장에서 정체성의 혼란이 일어나게 된 법적 배경이 된 것은 물론, 우리나라 ‘사회교육’의 오랜 역사적 전통과의 암묵적인 단절에 기여하는 결과를 가져왔다. 이러한 정체성의 혼란을 바로 잡기 위해서는 ‘사회교육’ 용어를 되살려 학문적으로 ‘평생학습학’과 ‘사회교육학’을 별도로 정립하고, 법적으로 ‘평생학습법’과 ‘사회교육법’ 등을 별도로 제정하여 그 위상을 재정립하는 것이 필요하다.

다국어 초록 (Multilingual Abstract)

In the end of 1990s, the abrogation of Social(Adult) Education Act and the enactment of Lifelong Education Act became the important momentum of declining of the term 'social(adult) education' and prosperity of the term 'lifelong education'. This thesis attempts to verify the historical rightness of dominant position of the term 'lifelong education' through analysing the discussions about the name of newly revising law and its position in the system of educational laws.
At that time, the Presidential Commission on Educational Reform choose a second best plan to expand and change the 'Social(Adult) Education Act' to 'Lifelong Learning Act' under the 'Framework Act on Education', and replace the term 'social(adult) education' with the term 'lifelong education'. But, because of government's will to maintain the consistency with other educational laws, the name of 'Lifelong Learning Act' was modified to 'Lifelong Education Act', and the area and status of the law was also reduced largely in the end.
As a result, we could not get not only a justification to make a mother law which include all area of education in the name of 'Lifelong Learning Act', but also actual profit to expand the area of 'Social(Adult) Education Act' sufficiently. On the contrary, owing to replacing the term 'social(adult) education' with the term 'lifelong education', the conceptual confusion happened between the narrow sense and wide sense of lifelong education.
It was a result of excessive applying of extensive perspective toward the term 'lifelong education' and exclusive perspective on the term 'social(adult) education'. That became the legal background of conceptual confusion in the area of lifelong education, and made tacit gap with the long tradition of 'social(adult) education'.
To resolve this problem, it is necessary to revive the term 'social(adult) education' first of all. And we must establish separately 'science of lifelong learning' and 'science of social(adult) education' academically, and also 'Lifelong Learning Act' and 'Social(Adult) Education Act' legally.
