장사제도의 개선방안에 관한 연구 = 장사 등에 관한 법률 개정안에 대한 의식조사를 중심으로

국문 초록 (Abstract)

화장시설이나 봉안시설 부족문제 해결을 위하여 2006년 4월 장사 등에 관한 법률 개정안이 공고되었다. 개정 법률의 핵심적인 내용은 화장시설 등 장례관련 시설의 확충과 자연장 제도의 도입, 장례업 종사자 자격제도의 도입이다. 본 연구는 장사법 개정안의 내용분석과 사회복지 관련자 들을 대상으로 한 실증조사를 통하여 장사법 및 장사제도의 문제점을 도출하고 그 개선방향을 모색하였다. 분석 결과 개정 장사법은 한국이 현재 안고 있는 장사제도의 문제를 해결하기 위한 방향은 잘 설정하였으나, 이행을 위한 충분한 조치나 한국의 전통적인 규범의 수용에서 한계가 있는 것으로 평가되었다. 따라서 관련 문제를 해결하고 법률의 실효성을 높이기 위해서는 특히 매장 및 개인묘지 설치 신고를 사망신고와 연계하여 운영하는 장사행정의 개선과 사설묘지에 대한 철저한 사후적 관리의 묘적부 관리를 강화할 필요가 있다.

다국어 초록 (Multilingual Abstract)

Even though the demand of cremation goes up recently, a notion of preferring a burial still steadily remains with the theory of ground configuration and Confucianism. And lack of crematoriums and charnel houses also can be a big problem of cremation. To find a solution to these problems, the government announced the bill of revision regarding funeral laws in April of 2006. The key points of the revised laws are expansion of funeral facilities for cremation and considerations, Introduction of natural burial, and introduction of the job qualification system for funeral services. This study aims to find a remedy of funeral system based on the problems of Korean funeral system and its law, through analysis of the amended funeral law and a field survey among the people who works for social welfare.
The survey shows that the amended funeral law has well established its direction to solve current problems of funeral system in Korea. However, it does not sufficiently contain specific ways of solving problems and traditional social norms of Korea. Therefore, the improvement of the conditions related to the funeral law is needed to solve the problems concerned with the increase of the law efficiency. Also the survey indicated the tight control of private grave yards and the strengthening of registration document system for a graveyard are recommended along with the improvement of the funeral administration by which the burial and the establishment of a private graveyard should be combined with a death notice.
