헌법상 교육기본권과 학교경영책임 = Constitutional Educational Basic Rights and Accountability of School Management

국문 초록 (Abstract)

역대 정부들은 교육개혁을 경제적 규제정책로 인식하여 실패를 초래했지만, 이는 사회적 규제정책에 입각하여 해결할 문제이었다. 더구나 현재 지방교육자치제도의 성패는 수요자 중심의 학교교육에 입각하여 학교경영책임이 강화되어야
한다. 헌법 제31조에서 부모의 학교선택권과 학교경영참가권이 교육기본권으로서 파생되고 있다. 단위학교경영책임은
운영주체로서 학교장과 교직원의 자율성과 책무성을 제고하는 동시에, 학부모와 지역주민에게 단위학교경영의 책임 및 평가에 실질적인 참여를 보장해야 한다. 현행 학교운영위원회가 형식적으로는 학교경영책임의 주체이지만, 학교경영평가에 대한 학교평가위원회가 부재하기 때문에 전문적인 학교인증제도를 위한 입법개선이 요구된다.

다국어 초록 (Multilingual Abstract)

The Choice Right of School and the Participation Right of School-Based Management as Constitutional Basic Rights, the Autonomy and Accountability of School Management, School Administration Committee and Evaluation
Committee of School Management, Certification System of School Approval. The late governments have resulted with the failure of education reform which was taken as regulation of economic policy so far, but I may assume
that problem is to approach through the view of social regulation policy. Hereafter the institution of local educational autonomy will be dependant upon whether the school-based management on the basis of school education for oriented educational consumer should be or not. Parents's choice right of school and participation right of school management shall be derived from a educational basic right in constitutional article 31. In particular, the institution of school-based management will raise the autonomy and accountability of principal and teachers as subject of school administration, and it has to guarantee substantial participation for parents and local residents to the accountability and approval of school-based management. School Management Committee is responsible for the subject of school management, because there is no the approval committee of school management and it request for the legislative amend for the professional
approval institution of school evaluation now.
