다문화사회와 헌법

다국어 초록 (Multilingual Abstract)

A society, in which various people with various cultural background live together can be called 'Multicultural society'. The solution of the problems in such society should correspond to the history and style of its formation. Korea, classified as a traditional nation-state, is faced with new and unfamiliar social problem, namely 'multicultural phenomenon' according to rapid growth of immigrants. A lively discussion of multiculturalism took place in recent years and several legislation were enacted. But most of them are no more than foreigner policy aiming at integration close to assimilation. Therefore, I suggest more multifarious aspects should be taken as a constitutional consideration for muliticultural phenomenon in Korea: overcoming the old ideas of national identity and cultural identity; new understanding of the relationship between traditional culture and foreign culture; recognizing the universal constitutional value as well as principle of tolerance, and protecting of individual's fundamental rights and minority's rights therethrough.
