한국 성범죄자의 보호관찰 위반 요인에 관한 연구

국문 초록 (Abstract)

본 연구는 성범죄자를 대상으로 보호관찰 위반에 영향을 미치는 요인을 탐구하는데 목적이 있다. 2009년 4월 20일부터 12월 15일까지 전국 27개 보호관찰소(지소 포함)에서 GPS 위치추적 전자감시를 끝마친 186명의 성범죄자를 연구대상으로 하였다. 분석 결과, 인지왜곡 정도에서는 성범죄자의 62.9%가 강간은 순간적인 성충동에 의한 것이라고 합리화하고 있음이 밝혀졌다. 발찌 착용 기간 동안 전자장치 훼손충동을 느꼈다고 밝힌 성범죄자가 87명으로 전체의 46.8%에 해당하였고 주의 또는 구두 · 문서 경고를 받은 범죄자가 74명으로 전체 응답자의 39.8%에 해당하였다. 발찌 훼손충동에 대한 로지스틱 분석결과, (1) 성범죄자의 교육수준, (2) 판결결과에 대한 불만족, (3) 비행교우 여부가 준수사항 위반 가능성에 영향을 미치는 유의미한 변수로 나타났다. 즉, 범죄자의 교육수준이 높고 처벌내용에 대한 불만이 클수록, 그리고 비행교우들과의 접촉이 클수록 준수사항 위반 가능성이 증대되는 것으로 나타났다. 교정정책 측면에서 관련 요인들에 긍정적인 영향을 미칠 수 있는 효과적인 보호관찰 준수사항 순응 유도정책이 요구된다 하겠다.
