국제적 조직범죄의 위협과 국제사회의 대응방안

국문 초록 (Abstract)

현대사회에서 인간다운 삶은 매우 중요한 요소이다. 오늘날 인류사회를 위협하는 요소로 국제조직범죄의 위협이 있다. 국제조직범죄집단은 개인의 정신을 황폐하게 하는 마약 거래를 비롯하여 불법이주자 수송, 무기 불법거래, 여성, 아동에 대한 인신매매, 자금세탁 문화재 밀거래 등 수입을 올릴 수 있는 모든 사업에 관여하고 있다. 국제조직범죄집단은 테러집단 또는 반정부집단과 연계하며 마약판매, 자금세탁, 위조지폐 등으로 활동자금을 확보하여 국제평화에 위협이 되고 있다.
이러한 국제조직범죄를 막기 위하여 국제사회는 다양한 노력을 하고 있다. 국제사회는 주권국가로 이루어진 사회이기 때문에 형사사법분야의 협력과 관련해서는 국가형벌권이 침해될 우려 때문에 소극적 협력에 그치고 있었다. 그러나 국제조직범죄의 위협에 공동으로 대처할 필요성이 높아지면서 마약분야에 대한 협력을 시작으로 국제사회에서 공동으로 조직범죄에 대응하기 위한 방안들이 강구되고 있으며 상당한 성과를 거두고 있다. 국제사회에서는 자금세탁과 불법자금의 몰수를 통하며 국제조직범죄집단을 무력화시키는 방법을 집중적으로 강구하는 동시에 이를 위한 국제협력방안이 모색되고 있으며, 국제조직범죄방지협약을 통한 협력을 더욱 공고히 하고 있다. 국제조직범죄를 방지하는 것은 결국 인간의 삶의 질을 높이는 길이기 때문에 이에 대한 협력은 매우 중요하다.

다국어 초록 (Multilingual Abstract)

Currently, international crime organizations have become one of the major threats which affect lives of many around the globe. International crime organizations are now involved in almost all kinds of lucrative businesses including drug dealing, human trafficking of women and children, money-laundering, illegal trade of arms and cultural artifacts, and so on. These organizations also constitute threats to international security since they help terrorist groups in money-laundering, drug dealing, and forging of counterfeit money, thereby helping terrorist groups secure source of money for further terrorist acts.
Though international community makes various efforts to prevent these international crime organizations, these counter-activities done by individual nations, especially in terms of international cooperation, have been limited to a certain boundary because of the possible conflict between the principle of national sovereignty and the criminal sanction. However, as the need for the cooperation among nations to cope with international crimes increases, there has been serious efforts to promote cooperation among nations, producing significant outcomes with international cooperation to reduce international drug dealing as one of the examples of great success.
International community has been working hard on the forfeiture of money involved in illicit businesses including money-laundering as one of the efforts to decapacitate the international crime organizations, and United Nations Convention Against Transnational Organized Crime helps promote the international cooperation.
