매춘 성노동의 이론화와 성/노동/상품의 위계화

국문 초록 (Abstract)

이 글은 2004년 9월 23일 성특법이 시행된 이후 전개된 성매매근절과 성노동 논쟁의 연장선상에서 매춘이 갖는 노동으로서의 성격을 이론적으로 설명하려는 초발적 시도다. 성특법 시행 이후 집장촌 매춘에 종사하는 여성들이 자신들을 성노동자로 명명하면서 국가법과 매춘을 둘러싼 낙인에 저항하는 움직임을 해오고 있다. 그러나 성노동자들은 집장촌 페쇄와 재개발이라는 상황에 직면하여 생존권, 주거권, 노동권, 인권 자체를 보장받지 못하고 있는 현실이다. 현재 지구지역적으로 성노동자들의 권리를 위한 움직임이 더 강해지고 있지만 정작 성노동자들은 국내외적으로 성매매근절론과 인신매매근절론에 직면하여 어려운 삶을 살고 있다. 이러한 상황이 지속되는 이유로 매춘과 여타 다른 성산업의 성노동에 대한 낙인을 들 수 있다. 이러한 낙인은 매춘이 노동이라고 인정하지 않는 것과 연결되어 있다. 매춘을 노동으로 인정하지 않는 것은 매춘을 둘러싼 쾌락, 노동, 상품의 위계화를 보지 않기 때문이기도 하다. 성특법 시행이 5년째로 접어드는 현재 매춘이 갖는 노동으로서의 성격에 대해서는 여전히 회의적이다. 따라서 매춘의 노동으로서의 성격에 대한 이론화도 제대로 되어 있지 않다. 그리고 성행위와 성적 쾌락에 대한 위계적 인식도 여전하다. 어떤 것이 노동이고, 어떤 것이 노동이 아닌지에 대한 위계화도 여전하다. 그리고 어떤 서비스상품은 예술이고, 어떤 서비스상품은 성의 상품화라는 이름으로 설 자리를 잃는다. 이 글은 국내외의 매춘 성노동자들의 생존권이 인정될 수 있기를 바라는 마음에서 이런 위계화를 설명하고 매춘의 성적 노동으로서의 성격을 이론화하려는 시도다.

다국어 초록 (Multilingual Abstract)

This article is an attempt to theorize prostitution as labor in the context of the debate between the abolition of prostitution and the advocacy for sex work after the enactment of the ‘Preventive Act of Prostitution’ in Korea in 2004. After the enactment of the Law, the prostitutes in the Red Light Districts have demonstrated against the government and have claimed to be acknowledged as workers. The prostitutes at this moment are encountering the compulsory closing of the Red Light District under the name of regentrification. Thus they experience the lost of their right to live and work. At present, although the movement for the sex workers’ rights has been empowering in and out of Korea, the prostitutes all over the world have to survive a hard life facing the abolition of prostitution and sex trafficking.
The reason why this situation does not disappear is the existence of criminalization and stigmatization against prostitution and other sex industry works. The stigmatization is closely related with the disapproval of prostitution as labor. It is the hierarchy of sex, pleasure, labor and product that prevents people from acknowledging prostitution as labor. In spite of the sex workers’ rights movement during the last 4 years after the enactment of the Law, there is still a negative concept about prostitution as labor. And there are not many attempts to theorize prostitution as labor. And the hierarchy of sex and sexual pleasure, labor, and product is still powerful. It happens quite often that one work is labor and the other is not, and one service product is art and the other is crime under the name of sex-commercialization.
In this circumstance, this article tries to analyse the hierarchy related with prostitution and theorize prostitution as labor hoping that the sex workers’ rights to live can be accepted in and out of Korean society.
