영국 2003년 커뮤니케이션법 제정에 따른 외주정책 평가

This study deals with new independent production policy that Communi-cations Act 2003 has set out in UK. Communications Act 2003 provides that the regulatory regime for every licensed public service channel should include conditions, to be set by Of com, that ensure the terrestrial broadcasters draw up, maintain and comply with Codes of practice governing the commissioning of independent productions for broadcast on their networks. Regulatory body, broadcasters and independent producers have agreed the new independent production framework.
A key principle underlying the new independent production framework is that independent producers should retain rights in their programmes unless these are explicitly sold to broadcasters and other parties. Each broadcaster also should develop a list of indicative tariffs relating to fees for primary rights. The regulatory body, Of com, secures that procedures exist for reviewing the arrangements adopted in accordance with the code and for demonstrating compliance with it; those procedures include requirements for the monitoring of the application of the code and for the making of reports to Of com; provision is made for resolving disputes arising in respect of the provisions of the code (by independent arbitration or otherwise) in a manner that appears to Of com to be appropriate.
An important objective of the new policy is to secure a clear and transparent process for commissioning and to enhance the relationship between broadcasters and the independent producers. Although it is too early to evaluate the new independent production policy fully, there is more scope for independent production to enhance audiovisual contents industry in UK.
