상가건물임대차보호법의 문제점과 개선방안

국문 초록 (Abstract)

상가건물임대차보호법의 2002년 11월 1일 시행되어 상가건물의 임대차를 보장하고자 하고 있으나, 현행 시행되고 있는 법률에는 여러 가지 문제점이 나타나고 있어 그 개선방안을 제시하기 위해 다음과 같은 쟁점들을 다루었다.
첫째, 그 적용범위의 문제. 둘째. 대항력의 문제. 셋째, 존속기간의 문제. 넷째, 권리금의 문제이다. 이러한 문제점들을 해결될 때, 상가건물 임대차에 있어서의 사회적ㆍ경제적 약자인 임차인들을 보다 적극적으로 보호할 수 있으므로, 임차인들의 경제생활의 안정을 도모하기 위한 상가임대차보호법의 제정목적에 부합할 수 있을 것이다.

다국어 초록 (Multilingual Abstract)

Business Building Lease Protection Act(hereinafter referred to as "BBLP Act") which was enforced on November. 1, 2002 has the purpose to secure the lease of building for business. But be in force BBLP Act has many problems with the consequence that BBLP Act was examined and some improving measures were suggested by treating the issues below. Firstly. there is a problem of applicative scopes of BBLP Act. Secondly. there is the problem of the opposing powers of the lessees. Thirdly. there is the problem of the term of existence. Fourthly. there is the problem of the foregift.
When the like this problem points are solved. the social and economical weak in business building lease were protected positively. BBLP Act for stability of economic life of a lessee coincides with accomplish it's purpose.
