성매매 특별법의 보호와 처벌 담론 육체와 권력의 관점에서

국문 초록 (Abstract)

이 연구는 성매매 특별법의 미디어담론을 권력과 육체의 접합관계 관점에서 권력 일반과 육체 일반의 보편적 훈육 관계가 아닌, 복잡한 사회적 관계 속에서 차별적 육체로부터 차별적 권력효과가 발생하는 지점에 주목한다. 젠더화된 타자가 단지 ‘비가시적’ 존재로서가 아니라 오히려 과잉된 가시성을 확보하게 되는 복합성을 파악하기 위해, 첫째, 성매매 규제에 의한 성매매 주체의 자기소외 현상을 살펴보고, 둘째, 성매매 특별법에 관련한 보호 및 처벌 담론의 속성을 이해함으로써 규율 권력의 모순성을 분석하고, 셋째, 육체적 생존과 사회적 재현의 분리현상에 주목함으로써 타자화된 주체의 물질적·상징적 재현방식을 해석했다. 국가권력이 지금까지 ‘맨육체’로서 존재하던 성매매의 육체를 적극적으로 가시화하지만 동시에 성매매 여성의 개인적 삶은 시민의 삶의 영역으로부터 더욱 배제되었다. 따라서 육체 담론 지형의 민주화는 맨육체가 새로운 언어를 통해 재현될 수 있는 가능성에 의존하고 있음을 제안한다.

다국어 초록 (Multilingual Abstract)

This study approaches Act on the Punishment of Procuring Prostitution and Associated Acts and Act on the Prevention of Prostitution and Protection of Victims Thereof in terms of articulation of power relations to the body. Prostitution in this perspective is thought to be a channel mediating through which power comes to involve in defining and placing the human subject according to the system of normalization. Three areas are examined: the phenomenon of self-alienation in the repressive and/or voluntary practice of prostitution; contradictions between the logics of protection and punishment, both intertwined in the juridical discourse of prostitution; separation between biological survival and discursive representation.<br/>
Three interpretations are induced. Firstly, a legal view identifies the cause and effect of prostitution, which is in turn brought into the judgement of the agency acting of prostitution. Secondly, an enlightening perspective stressed by feminist civil action groups underlines the necessity of cure and education in encouraging de-prostitution. The last position is argued by some prostitutes who claim for the legitimation of prostitution in the ground that prostitution is a part of social labour. A key issue underlying these arguments under is on the life and death of the prostituting body, which obviously regulated by the legal and social discourse.<br/>
In enacting the laws, governmental power visualize a ‘bare life’ within a social discursive space. The prostitution body is interpellated as a prostitution offender/victim and whorehouse as a community space in an official framework of reformation. It becomes dramatically visualized in a social discursive space. This way of new-naming authorizes the ‘inclusive exception’ within civil society. At the same time, this also has an effect of excluding the bare body by effacing her individuality as a agency of desire and autonomy for her own life. She is all but a normal human: not-yet-human or non-human. The body is both an object on which power operates (interpellating, placing, classifying and unifying) and a site within which power eventually becomes actual. Furthermore, the body of a bare life is then a threatening body, for it potentially performs in obscuring and diverting the official state power. <br/>
Thus it is suggested that the democratization of discursive topography depends on the possibility, the possibility in which a new language is created for the self-representation of a bare life. Furthermore, we may also expect a potentiality in which the body of a bare life is a language representing the fallacy of the universalistic framework of the state power. Thus, the creation of language is required which gives expression to the present reality of suffering and mourning apart from the futuristic fantasy of happiness, the power always promises.
