보편인권체계에서 배제된 사회적 소수자의 인권: 노숙인의 사례를 중심으로 = Social Minorities and Universal Human Rights System: A Case Study of Homeless People

다국어 초록 (Multilingual Abstract)

The aim of this study is to demonstrate how universal human rights system excludes social minority groups, who cannot keep up with into the ``universal`` conditions of majority people. In general, human rights have been appreciated as supreme social value for minority protection. But, through a case study of homeless people, this article point outs that human rights are not natural rights for all human beings, but exclusive social mechanism for social majorities, called denizens, family members, housing dwellers or paid workers. It also reveals how social welfare system, which is supposed to guarantee minorities` social rights, is likely to incur infringement of their rights to freedom. In order to reduce such human rights exclusion of minority groups, this article suggests the introduction of ``difference-sensitive universalism`` into current universal human rights system.
