성적 행위의 범죄화: 한국, 독일, 일본 비교 = Criminalization of Sexual Acts: The Comparison of South Korea with Germany and Japan

다국어 초록 (Multilingual Abstract)

We have constantly maintained Criminal Law and enacted special act in order to prevent sexual offence. Nevertheless, crimes involving sexual acts are constantly increasing. Especially the rape and infamous conduct which infringe on right to sexual autonomy related to sexual acts, the sexual traffic which infringes on sexual morals are increasing mostly, Although the law are enacted and amended, the reason that the act could not gain the effect is sexual acts crime rapidly evolves and takes place secretly. This Article is finding the answer that how we prevent increasing sex offenses and look for effective preventions, At First, we define the definition of sexual acts which subject to criminal punishment and at second, we look at how our criminal law criminalize the sexual acts, thirdly we are looking at how the German and Japanese criminal law criminalizes the sexula acts. Through comparison with the German and Japanese Criminal law which had influenced to our Criminal law we are finding the problem of our one. Finally, we will take a consideration of a solution for problems of our Criminal Law.
