유럽연합의 제3국 이민 정책 변화에 대한 과정적 접근 = The process of the formation and change of Immigration Policy of Third Country Nationals in European Union

다국어 초록 (Multilingual Abstract)

This current article summarizes the latest information on the flows of migration in EU. And this article examines backgrounds and changes in immigration policy of third country nationals through a critical analysis of directive, communication, and treaties. The results are follow : First, the most comparable cross-national data come from Eurostat, which indicate that Germany had largest flows of migration in the 2011 followed by Spain. And looking at the distribution by continent of origin of third country nationals living in the EU, the largest proportion were citizens of a European country outside the EU-27 followed by Africa and Asia and America and Oceania. Second, EU strengthened EU' citizenship and controled external border for internal integration, and excluded third country nationals. Third, EU formed the basic for common immigration policy by the Treaty of Amsterdam.
And after Tampere European Council, EU strengthened 1)partnership with countries of origin, 2)common European asylum system 3) fair treatment of third country nationals 4) management of migration flows. Fourth, after Tampere European Council, EU developed framework for an EU immigration policy and prepared measures of admission of migrants. Generally, EU constrained the third country nationals entry into EU and consolidated conditions for residence. And for benefit from immigration policy, EU's immigration policy imposed selection criteria that are more in line with economic motives. For this reason, EU introduced Blue-Card Directive, are getting ready for Seasonal Worker Directive. Somewhat illegal immigration policy easily came to an agreement, EU strengthen sanctioning those who hire illegal workers, the management and cooperation for external border controls. And EU strengthen return and readmission policy for comprehensive and sustainable migration policy and facilitate reintegration non-EU nationals who are staying in the EU irregularly.

국문 초록 (Abstract)

이 연구는 최근 급격하게 변화하고 있는 유럽연합의 제3국 이민 정책을 살펴보고자 하였다. 이를 위해 Eurostat 통계 자료를 활용하고, 유럽연합의 제3국 이민정책과 관련된 다양한규칙, 통보, 조약 등을 살펴보았다. 연구 결과에 의하면, 첫째, 2011년 현재 유럽연합 회원국중 제3국 국민이 가장 많은 국가는 독일이고, 제3국 국민의 출신국은 아직 유럽연합에 가입하지 않은 유럽 국가들이 가장 많고, 그 다음이 아프리카, 아시아, 아메리카, 호주 순이다. 즉, 유럽연합의 이민 흐름은 여전히 유럽 대륙의 내부 이동이 가장 크며, 그 다음이 과거 유럽 국가들의 식민지 국가들에서의 유입이 가장 컸다. 둘째, 유럽연합은 1985년 쉥겐 협약을 통해 외부로부터 유입되는 인구의 규제를 강화하고, 1997년 암스테르담 조약을 통해 공동의 이민·망명정책을 위한 기반을 마련하였다. 그리고 유럽연합은 템페레 유럽이사회 이후 제3국 이민의 문제에 대응하기 위해 공동의 입국 및 체류 기준을 마련할 것에 합의하고, 유럽연합 회원국뿐만 아니라 송출국과의 협력을 강화하는 방향으로 나아가고 있다. 셋째, 2000년대 이후에는 템페레 유럽이사회에서 제시된 이행 지침에 따라 선택적 이민 정책을 강화해 나가고 있다. 즉, 비경제적 이민의 범위를 가족 재결합에 따른 이주, 유학생 및 연구생 등으로 한정하고, 경제적이민의 범위를 고숙련 전문직 노동자와 계절적 노동자로 제한하여 이들에 대한 통합을 강화하였다. 넷째, 불법 이민자 문제에 대해서도 유입, 체류 등 이주 단계별로 접근함으로써, 불법이민 문제에 이전보다 체계적 관리를 강화해 나가고 있다. 마지막으로 이상의 연구내용을 토대로 한국의 이주노동자 정책에 주는 시사점을 논의하였다.
