네거티브 규제와 규제 방식의 개선 = Negative regulation and improvement of regulatory form

국문 초록 (Abstract)

네거티브 규제 방식이란 "규제의 근거가 되는 법령에서 특정한 사항을 열거하여 제한적으로 금지시키는 방식으로 되어있는 규제"로 정의할 수 있을 것이다. 규제의 형태가 네거티브 형태로 바뀐다면, 포지티브 방식에 비하여 기업의 자율성과 영업의 자유를 보장해 줄 가능성이 높다. 절대적인 것은 아니지만 네거티브 규제 방식은 포지티브 방식보다 행정청에 의한 제한이나 수범자의 행위에 대한 제약이 적어, 상대적으로 규제 수범자의 자유를 보장해 줄 수 있다. 또한, 규제당국의 행정비용이 경감될 가능성도 있다. 결국 네거티브 규제의 핵심은 명확화, 단순화하고 행정비용과 수범자의 행정 부담을 경감시키는 규제를 만들자는 것이며, 네거티브 규제가 성공적으로 받아들여지기 위해서는 자유롭고 공정한 시장의 기본적 기능이 전제되어야 할 것이다.

다국어 초록 (Multilingual Abstract)

A negative regulation can be defined "A regulation in a way that restrictions on the basis of law enumerates certain matters". If forms of regulation change into negative list forms, undertaking would be guaranteed economical autonomy and the freedom of trade more than in a positive way. Negative regulatory approach is relatively less restrictive to conduct of private sector. In addition, the administrative costs of regulatory authorities are likely lessen. Eventually the main object of the negative regulatory method can make regulation more simple and administrative costs less. But negative regulation would be successful in case that free and fair market economy is well-functioned.
