독일 통신 시장의 경쟁과 규제 개혁 = Competition and regulatory reform in the German telecommunication market

국문 초록 (Abstract)

독일의 통신 규제는 통신 시장에서의 유효한 경쟁에 근거한 통신정책을 수행하기 위하여 질서를 재편하고 소비자 보호를 위한 통신법의 재형성이라는 중요한 과제에 직면해 있다. 따라서 독일 통신시장에 있어서의 규제는 EU 지침에서 규정된 가격 및 접속규제의 틀을 따르면서 동적 효율성과 낮은 가격으로 고품질의 서비스를 제공하고 기술적 진보를 달성하여야 한다는 요구에 부응하고 있다. 그러기 위하여 독일의 통신법은 기존의 사전 규제(ex-ante regulation) 방식의 틀을 과감히 탈피하고, 사후(ex-post) 시장감시 규제를 통하여 신뢰할 수 있는 경쟁 상태를 지속함과 동시에 시장에 대하여 신축적인 법 적용을 할 수 있도록 규정하고 있다. 독일 통신 규제는 주파수 배분, 번호 배분 등을 포함한 시장 진입규제, 접속과 사용료규제, 개인정보 보호를 포함한 이용자 보호, 그리고 통신감청을 포함한 공익의 보호 측면에 중점을 두고 있다. 우리나라의 통신규제는 여전히 방송통신위원회가 통신 사업의 허가를 비롯한 가격규제 등 사전규제 중심의 규제방식을 고수하고 있다. 시장의 현실에 맞지 않는 과감한 사전 규제의 혁파와 규제 내용 및 방식의 전환을 통하여 시장에서 유효경쟁을 촉진하고 소비자를 보호할 수 있는 규제체계의 변화가 시급하다는 것이 독일 통신 시장의 규제개혁을 통해서 얻을 수 있는 시사점이라고 판단된다.

다국어 초록 (Multilingual Abstract)

The regulation of telecommunication market in Germany aims at competitive market structure and enhancing welfare of telecommunication users. It follows also the European Directive package of 2002 about the telecommunication regulation. Access, spectrum, numbering, authorization and the protection of individual information regulation focus on dynamic efficiency and high-qualified service without any discrimination from the technical difference. German telecommunication act was revised toward the deregulation and ex post regulation in the telecommunication market instead of unnecessary ex ante regulation from the regulatory body(Federal Network Agency).
The situation of Korea is still serious. KCC has heavily impact on the telecom undertakings with relation to ex ante regulation. It would impede the competition of the market and freedom of undertakings. The regulation should be made up in favor of consumer welfare and effective competition of the market.
