    Recently, RFID technology that realizes Ubiquitous Society attracts worldwide attentions. RFID technology has the problem of privacy caused by it s tracking function and database system. On the other hand, this technology also has possibility to construct Security System that shall be able to protect people who need to care, such as kids and dementia patients. For example, RFID chips which will be put onto kids school-bags, name tags or clothes can help parents to track their kids movement. Governments of the advanced countries like America and Japan have been already trying to find a solution to provide the best lifestyle for the future in formation society through technical merit of RFID. Academic world also consider the protection of private in formation and the invasion of privacy by RFID tag s using so they are sincerely developing the expected problem on the technology and law to make the desirable Ubiquitous Network society. For example, it s Food Safety System, School Attendance Check System which are experimented from America and Japan etc. However, such as the location follow-up function by RFID technology apply to human is rebelled from citizen organization systematically, because it makes disturb privacy and it treat human as if human is animal or burden.
    This paper presents the issues on RFID tags applied Social Security System in USA and Japan, and analyzes our government s U-Society Security System Construction Model Business. Also this paper presents some legal analysis on these issues and resolutions to improve current law system.
