노동조합의 파업이 기업성과에 미치는 효과에 관한 동태적 분석: 패널자료 분석 = The Dynamic Analysis of Strike Impact on Corporate Performance

This study analyzes empirically the impact of labor union strikes on worsening corporate performance using the Korean corporate panel data. The empirical result leads to the conclusion that the existence of a union precipitates financial weakening. The policy implication would thus be that efforts must be made to revise laws or reform industrial relations to ensure that labor unions play a more positive role. This study recommends several points from the perspective of law and economics. First, it examines ways to improve labor legislation based on panel data analysis. Second, it aims to suggest amendments to the legal system to enhance economic efficiency through mutually beneficial industrial relations, not simply pursuing the protection of union or worker rights. Third, the paper approaches labor market flexibility by recognizing that restructuring of struggling companies via mergers, acquisitions and transfers must take place before easing the criteria for legal layoffs at healthy companies.

국문 초록 (Abstract)

본 연구는 파업이 기업성과에 미치는 효과를 실증분석 한다. 실증분석에서는 1997년에서 2002년까지 노동부에서 작성한 『노동백서』와 『전국 노동조합 조직 현황』 및 『매일경제 회사연감』자료를 이용하여 패널 자료를 구축 한다. 이렇게 구축된 패널자료를 이용해 2단계 최소자승법(2SLS)과 패널분석을 실시하였다. 본 연구를 통해 파업발생 확률에는 기업 재무정보보다는 과거의 파업발생여부, 과거 불법파업 발생여부, 과거 파업참가자 수 등 과거 파업의 양태가 더 유의적인 영향을 미침을 알 수 있었다. 파업이 기업성과에 미치는 효과를 살펴보면 우선 현재의 파업뿐만 아니라 과거의 파업도 현재의 기업성과에 부정적인 영향을 미치는 것으로 나타났다. 이는 일단 파업이 발생하면 당해년도 뿐만 아니라 누적적으로 미래의 기업성과에 부정적인 영향을 미침을 알 수 있다. 또한 과거의 파업이 불법파업일수록 현재의 파업확률을 높여서 현재의 기업성과에 부정적이었다. 본 연구는 또한 패널분석을 통해 노조의 존재여부와 파업이 기업성과 즉 기업부실화에 어떠한 영향을 미치는가를 살펴보았다. 노조의 존재가 기업성과를 반드시 낮추는 것만은 아니라는 사실을 보여주었다. 하지만 파업이 잦을수록 기업은 부실화 되는 것으로 나타나고 있다. 본 연구는 생산성 제고를 위한 몇 가지 노사관계 개혁방안으로 사용자 측의 경영 불투명성제고와 취약한 노동조합의 리더십과 분산된 계파문제로 야기되는 노사관계의 불안정성 해소를 제시하고 있다.
