This study examines the effect of the newly enforced Employment Permit System (EPS) of the ROK Government on the interests of foreign workers in Korea. The new EPS which came into effect as of July 1, 2004 was designed to guarantee higher salaries, respect for human rights, and more stable employment conditions for foreign workers, however, it has become an object of fear for many foreign workers.
This study firstly, attempts to find out the reason why 「The above mentioned EPS」is not welcomed by foreign workers and secondly, provides suggestions, particularly for Korean NGOs who have taken the initiative in pushing the ROK Government to formulate the EPS, so that the NGOs reduce their rather excessive care for foreign workers.
This study has identified that too much care for, or concern of, Korean NGOs for foreign workers in Korea greatly harms both Korean employers' and foreign workers' interests, as the new conditions created by the EPS in favor of foreign workers has led to employers reducing job opportunities for foreign workers and/or moving their production lines abroad. In other words, the unfavorable reality on the side of the Korean employers as a result of the enforcement of the EPS has led to Korean employers hesitating or avoiding the employment of foreign workers, resulting in foreign workers in Korea being deprived of employment opportunities or, at least decreasing employment opportunities for foreign workers. It was noted that the majority of foreign workers who were relatively satisfied with their salary level, human rights situation and other issues in the past. are now suffering confusion because of the enforcement of the EPS. This is counter to the original intention of the EPS, as the adverse effect on foreign workers' interests by lessening or depriving them of job opportunities, is a direct result of Korean employers' dissatisfaction with the EPS.
This contradictory situation suggests to Koreans, especially to NGOs advocating foreign workers, to pursue a more balanced or neutral attitude between the Korean employers and foreign workers guaranteeing a Win-Win result for both Korean employers and foreign workers.
