교육의 자주성¹)에 관한 헌법재판소 판례 분석

국문 초록 (Abstract)

본 연구의 목적은 교육의 자주성의 개념, 성격, 내용, 그리고 제한에 관하여 고찰하는 것이다 본 연구의 방법은 헌법재판소 판례 분석이다 본 연구의 주요 결과는 다음과 같다 첫째, 헌법재판소는 교육의 자주성의 개념을 교육에 대한 외부세력의 부당한 개입의 배제 (기관 자치)와 교육기관구성원들에 의한 자주적 경영 (구성원 자치) 으로 규정하고 있다 둘째, 현법재판소는 교육의 자주성의 성 격을 교육의 본질 실현 헌법의 기본원리 구현, 국민의 기본권 보장, 국가 발전에의 기여, 그리고 교육제도의 기본원칙으로 이해하고 있다 셋째, 헌법재판소 는 교육의 자주성의 내용을 교육기관의 자주성, 교육내용의 자주성, 그리고 교원의 자주성으로 파악하고 있다 끝으로, 헌법재판소는 교육의 자주성의 내재적 한계로 학생의 권익과 복리 증진 및 사회윤리를, 교육의 자주성을 제한하지만 헌법에 위반되지 않는 경우로 사회공공의 이익, 대체수단의 존재, 현실적 제약 등을 제시하고 있다.

다국어 초록 (Multilingual Abstract)

The major purpose of the study is to analyze the constitutional court cases on educational autonomy critically. The court's viewpoint on educational autonomy is as follows. First, the constitutional court has used two different approaches to the definitions of educational autonomy, one is to define it with other constitutional principles of educational governance and the other is define It alone. Regardless of the approach educational autonomy means the prohibition of the outsider's invalid interference with education and autonomy by the educators. Further, educational autonomy has five characteristics: the embodiment of the essence of education, the embodiment of the basic principles of the constitution, the assurance of the people's fundamental rights, its contribution to national development, and the principles of educational institutions. Moreover, educational autonomy consists of the institutional autonomy, the autonomy of educational content, and teacher autonomy. The institutional autonomy consists of freedom from the educational supervisor, the public election of the educational management institutions and the private school autonomy. Teacher autonomy consists of the assurance of teacher's Job security and job autonomy. Finally, educational autonomy has inner limitations for increasing student's rights and welfare and preserving the contemporary social ethics Also, educational autonomy can be restricted without violating the constitution for public interest and some practical consideration such as cost, personnel, etc. and when there are alternatives for educational autonomy The Constitutional Court s viewpoint has some weaknesses. First, by defining educational autonomy With other constitutional principles of educational governance the court makes the relationship between educational autonomy and these principles ambiguous. Further, unlike the court's viewpoint educational autonomy is contradictory to some basic principles of the constitution such as the welfare state and international peace. Moreover, what consists of the institutional autonomy and teacher autonomy is inappropriate. Finally, the inner limitations of and the reasons for the restriction of educational autonomy are overlapped and subjected to the arbitrary and multiple interpretation.
