미국의 건국정신과 헌법정신의 함의 = The implication of the spirit of the foundation and the spirit constitutional of America

국문 초록 (Abstract)

미국의 건국정신은 신대륙에 새로운 헌법과 제도 그리고 새로운 정치사상을 바탕으로 한 새로운 모델의 정치제도와 인간의 생명, 자유, 행복추구의 자유정신을 실천하고자 하였다.
미국의 헌법은 엄격한 삼권분립제를 기초로 하여 정치제도로서 지구상에 처음으로 대통령제를 채택하였으며 의회는 주민과 국민전체를 대표하는 상원과 하원의 양원제를 채택하였고 사법권의 독립을 확고히 규정하고 있다.
미국의 건국정신과 헌법정신은 국가의 어느 기관이나 제도 그리고 어떤 사람에게도 권한의 집중을 방지하고 권력분립에 기초하여 서로 견제와 균형의 원리에 의하여 각 기관이 자율성을 갖고 제 기능을 하도록 하고 있다는데 그 특징이 있다.
미국의 건국과 헌법정신과 그 후의 실천과정에서 우리가 배워야 할 교훈은 미국 헌법은 218년 동안 법과 제도의 골격과 정신을 유지하면서 시대변화에 적응하여 탄력성 있게 민주적이고도 능률적으로 운용하고 있는 묘미와 미국 국민들과 지도자들의 타협과 관용의 살아있는 체험의 정신이라 할 수 있다.

The American foundation spirit was to practice not only a political system of a new paradigm based on a new constitute, a new system, and a new political philosophy but also human lifes, freedom, a right to be happy.
The American Constitute first selected the presidential government system, founded upon the respective independence of the three powers of administration, legislation and judicature, while the legislation employed the bicameral, represented for the people and the peoples, while the judicature firmly independent.
The spirit of the foundation and the spirit of the constitutional of America is featured to prevent from imbalancing the power of systems as well as institutes but to keep euilibrium and constraint each other and to run its sound function autonomously.
Through the spirit of the foundation, the spirit of the constitution of America, and its practice, what we need to learn is a lesson: the Constitute has been in homeostasis with the laws, the skeletal, and the spirit to adjust elastically following the changing society and environment for 218 years and furthermore has adapted the better democratic and the more efficient systems on each generation, resulting in negotiation and reconciliation in terms of living practical running systems among the people and peoples as well.
