통일시대를 대비한 헌법과 통일법의 과제 = Issues of Constitutional Law and Unification Law for the Preparation of the Korean Unification

The reunification of South and North Korea could happen suddenly when least expected. This is supported by the historic fact of the German reunification whereby West Germany was not at all prepared for such a sudden event. Preparation for reunification requires elaborate planning by researches that take into consideration the unique relationship between South and North Korea. Any research with respect to reunification should be done taking into account the current interactions between the two entities. Thus, it is important to analyze cases regarding inter-Korean trades. One should also focus on civil issues before reunification. There are pending law suits alleging inheritance rights by the descendants from North Korea. Since any reunification issue will ultimately be solved through the Constitution and statues, the role of lawyers will become more important. An understanding of legal issues concerning reunification will become more demanding, with lots of political and economical debates within South Korea. It is also important to note that events such as reunions of separated families during the Korean War, and the tourism in Mount Geumgang are necessary for the interaction of the two Koreas. Moreover, the Kaesong Industrial Complex is critical for the continuous cooperation between South and North Korea. New industrial zones established based on the success of Kaesong will introduce market economy to North Korea. In addition to that, collaboration between the two Koreas for the peaceful utilization of the demilitarize zone can provide a giant stepping stone for the Korean reunification.
