아동을 위한 법적 발전 방향 연구-아동기본법 제정을 중심으로- = A Study on Developing Korean Children Act

다국어 초록 (Multilingual Abstract)

This study has been carried out to suggest a policy system orienting steady development and growth of children from overcoming the passive attitude of Korean society towards Children's matter. Particularly, this study attempt to provide a base of law to current policy and services for Children, which is into force without the solid basis of relevant law, and to regulate the issues of policy and law raised within Korean society. Accordingly, UNCRC, which is a international human rights in relation to children, and the child welfare law, which is a representative law for children, have been analysed. Relevant references in the policy and the law of children have been studied.
This study suggested that Korean government should develope children act in the direction toward developing the rights of children who are to be respected as their personality, and supporting children's development from the view of protection for children. The Children Act is consisted of 6 sections and 45 articles and contains a system of formulation and promotion of the policy for children, protection of children's right, system of support and coordinated services for children and childnren' fund.

국문 초록 (Abstract)

본 연구는 아동에 대한 우리 사회의 소극적 태도를 극복하고 아동의 건강한 성장과 발달을 지향하는 법체계를 제안하고자 시도되었다. 특히 현재 법적 기반 없이 시행되고 있는 아동정책과 서비스에 대한 법 기반을 마련해 주고 그동안 제기되어 온 주요 제도적 쟁점을 정리하는데 초점을 두었다. 이를 위하여 아동관련 국제인권법규인 아동권리협약을 살펴보고, 우리나라의 대표적인 아동관련법인 아동복지법을 고찰하였다. 또한 아동관련법에 대한 국,내외 다양한 문헌연구를 실시하였다.
본 연구는 아동에 대한 보호적 시각을 탈피하여 아동의 성장을 지원하고 인격체로서 누려야할 권리를 제고하는 방향으로 아동기본법을 마련할 것을 제안하였다. 아동기본법은 6장 45조 구성되었으며 아동정책수립 및 추진체계, 아동권리 옹호, 아동통합서비스 및 지원체계, 아동기금 등의 내용을 포함하고 있다.
