    In court auction, the disposal of partitioned building which is contingent upon the validity of the right to use site involves a lot of risk to prospective buyers. The result of the disposal caused by part of exclusive ownership as well as people who are interested in the site could either lapse or recover their rights. This may arise from defective legal system and indefinite officialnotice. Under these circumstances, there are difficulties in procuring credit for both the partitioned building and for those who are interested in the percentage of land ownership as the outcome comprised of disposal at low price in court auction. Therefore, this research aims to investigate the drawback of confusion about the considerable scope of partitioned building, and attempts to study measures to solve the problem.
