상법상 특별배임죄에 대한 연구 = A Study on Special Crime of Misappropriation in Commercial Code

다국어 초록 (Multilingual Abstract)

Korean Commercial Code Articles 622 through 624 have penal provisions punishing misappropriation done by corporate officials including directors, promoters, auditors, etc., which are special provisions to misappropriation in the conduct of business prescribed in Korean Penal Code. Similar legislative approach is rarely seen except in German and Japanese law, and application of such provisions are not common in Korean practice. Thus this article shall examine issues and arguments such as the subject, the legal interest, and the nature of the crime from the perspective of criminal law, and analyze actual behaviors constituting misappropriation shown in domestic and foreign cases from the perspective of corporate law, and finally deal with the necessity and direction of revision.
