국적법의 세계적 동향과 한국의 현실: 시민권정책지수에 기초하여 = Nationality Law: Global Trends and the Korean Situation Observed through the Citizenship Policy Index

This study canvasses global trends in nationality law, and trends in Europe in particular, and analyzes the Korean situation using the Citizenship Policy Index (CPI) developed by Marc Morje Howard. The CPI is designed to evaluate a country`s citizenship law with reference to how liberal or restrictive it is. It employs indicators showing i) whether the country has a jus soli rule and which kind of jus soli regime it has, ii) how restrictive are the conditions of naturalization, and iii) whether one is required to renounce his/her previous citizenship when acquiring citizenship. The CPI is simple, which makes it useful at this stage of research where the comparative study of nationality laws has not sufficiently developed. This study is an experimental attempt to analyze Korea`s nationality law in comparison with the experiences of other countries by applying common indicators. The article evaluates the situation of Korean nationality law in the light of global trends discerned by the application of the CPI and simultaneously sheds light on the limitations of the CPI with reference to problems found in applying the CPI.
