여성의 병역의무에 대한 법이론적 고찰

국문 초록 (Abstract)

국민들의 기본권의식이 높아짐에 따라 직접적인 병력형성의 의무도 남성뿐만 아니라 여성에게도 부담지우는 것이 타당한 것이 아닌가 하는 논의가 제기되고 있다. 여성이 평등한 대우를 받기 위해 법적 개혁이 성공적으로 이루어진 곳에서도, 여전히 평등이라는 이름으로 남성이 혜택을 누리는 영역이 많다고 할 수 있다. 어쩌면 그래서 더욱더 평등권 보장을 이유로 여성에게도 병역의 의무를 인정해야 하는 지 여부가 문제되는 지도 모른다.
여성에게도 병역의 의무를 인정하는 것이 평등권보장에 합당한 것인지, 다시 말해서 여성에게도 병역법 제 3조 제1항에서 규정하는 병역의 의무가 인정된다면 진정한 의미의 평등이 달성되는지 문제가 된다. 이와 같이 평등에 관한 논의에서 현재 가장 활발하게 논의되는 분야가 여성과 남성에 대한 평등한 취급과 차이에 입각한 취급의 문제라고 할 수 있다. 그리고 차이에 관한 논의는 여성의 고유한 심리적 특성인 보살핌의 윤리를 강조하는 문화적 페미니즘의 입장과, 국가와 법의 남성성을 강조하는 급진적 페미니즘, 그리고 남성과 여성의 차이 뿐만 아니라, 여성 개개인의 차이까지도 주목하는 포스트모던 페미니즘의 입장이 있다.
위와 같은 페미니스트 법이론에 의거하더라도 평등하게 군대에 입대할 의무를 부담한다고 해서 사회 전반에서 남성에 대한 종속적 지위에 놓인 여성에게 평등이 실현될 수 있을까 하는 점에서는 여전히 의문이 남는다. 아직 우리 사회에서 남녀평등이 실현되고 있지 않은 상황에서, 이러한 의무부과는 오히려 남성지배와 남성문화를 공고히 하는데 일조할 가능성도 배제할 수 없다. 또한 여성에 대한 현역병 징집에 의한 병역의무 부과는 실질적 평등원칙에 부합하지도 않다.

다국어 초록 (Multilingual Abstract)

The subjects of national defense duties, as is stipulated in the constitution, are all citizens who are constituents of the nation in principle. The military service law, which stipulates in detail the duties of national defense, places the burden of direct military force formation duties only to men of South Korea.
As the debate on equality of men and women progresses and people’s perception of fundamental rights becomes more acute, a debate is taking place on whether or not it is proper to place the burden of direct military force formation duties not only on men but also one women as well. In other words, the issue is whether or not it is appropriate in terms of guaranteeing equal rights to acknowledge that women have a duty to serve in the military, whether or not if the military service act article 3, section 1, which describes military service duties, applies also to women that would achieve equality in its true meaning.
Women’s duty in entering the military in active service could have a formal significance in that they as citizens are shouldering equal amount of duty as well as equal amount of rights, but there are questions as to whether or not their taking on the burden of serving in the military as equals will realize equality for women who are generally placed in position of dependence regarding men in society. In a situation where equality between men and women is not being realized in our society, the possibility cannot be ruled out that such imposition of duty will only help to solidify male dominance and male centered culture.
Moreover, the imposition of military service in the form of enlisting women in active military duty does not correspond to substantial principle of equality. If there was a social or practical circumstance for the necessity of making women subjects of enlistment for national security and welfare, it would be proper to impose on women the duty of active military service as is done in Israel, but in a circumstance where such necessity does not exist, to claim that women must equally take on the same responsibility that men have can be said to be without sound basis when the characteristics of military duties or the physical and psychological characteristics of women are considered.
