트롤리문제의 해결을 위한 한 가지 시도

국문 초록 (Abstract)

Foot(1967)과 Thomson(1976)이 제기한 트롤리문제(trolley problem)에 대한 한 가지 해결책을 비결과주의 관점에서 제시한다. 트롤리사례들의 핵심적인 특징은 형식적으로는 동일한 구조를 가지고 있음에도 불구하고, 우리로 하여금 상이한 도덕적 판단이나 직관을 하게 만든다는데 있다. 따라서 트롤리문제를 해결하고자 한다면 관건은, 트롤리사례들을 어떻게 분류하며, 그렇게 분류할 정당한 근거를 제시할 수 있는지에 달려 있다고 본다. 본 논문에서는 트롤리사례들을 적대적 관계에서 경쟁의 두 유형과, 위험분배의 세 유형에 의거해서 분류한다. 또한 분류의 근거로는 구조행위에서의 공정성 개념을 제시한다. 구조를 하는데 있어서 제3자인 우리가 갖는 ‘위협’과 ‘위협의 분배자’로서의 지위에 대해서 논의한다.
본문에서는 위험회피문제(ducking puzzle)와 트롤리문제 간의 구조적 유사성에 착안해서 트롤리문제를 해결하려는 유력한 시도로서 Katz와 Haslett의 시도를 비판적으로 검토한다. 특히 제삼자사례를 정당방위의 원칙에 근거해서 해결하려는 Haslett을 비판하면서, 긴급피난에 의거한 해결을 시도한다. 끝으로 수단원칙인 이중결과론과 칸트의 인간성정식에 대해서 이음궤도사례가 갖는 의의에 대해서 논의한다.

다국어 초록 (Multilingual Abstract)

The aim of this paper is to provide a plausible solution to the Trolley Problem proposed by Foot(1967) and Thomson(1976) from a nonconquentialistic view point. The main distinctive feature of Trolley cases is that they cause us to have the conflicting moral judgements or intuitions despite their same formal structure. So the pivotal point of solving the trolley problem is to provide the classification method and its justificatory ground of trolley cases. This paper is going to present two types of competitions(recursive and nonrecursive) and three kinds of the distribution of risk(ducking, shielding, risk-originating). In regard to the justificatory ground, it will the fairness of saving. In addition, I will prove that the difference of moral status of ‘threat’ and ‘distributor of threat’ of distributor.
