A Study on Improvements of the Commercial Building Tenants Protection Law

“Commercial Building Tenants Protection Law” was enacted as National Legislation No 6542 on December 29, 2001 in order to solve the long-pending problem of protecting the petty tenants, but it has been argued that the law is not much valid.
This study aims to suggest some methods for the validity of the law by referring to foreign laws, experts' and public opinions.
It is thought that it is fortune to have enacted and enforced the Commercial Store Protecting store lessees which has been much disputed in its enactment. But many problems have taken place as a result of its enforcement with no sufficient consideration in the process of its legislation.
The intent of its legislation may be intended to protect the lessee of the small commercial store, but the clear-cut criterion has not been established in the coverage of its application.
It is hoped that the resolution of these problems will contribute to protecting the lessee of the small commercial store, the purpose of this Law, and ultimately guaranteeing the stability of national economy.
