문화적 권리와 보편적 인권 = 세계 인권 선언에서 문화다양성 협약까지

다국어 초록 (Multilingual Abstract)

This paper explores to what extent cultural rights belong to universal human rights. Modern human rights discourse should go beyond two barriers to reach a universal level: one is physical borders of nation state, the other is moral borders resulted from cultural difference. This author classifies cultural relativism into three categories such as descriptive, metaethical, and normative relativism, and cultural universalism into also three levels such as concept, interpretation, and implementation. Then I explain the meaning of culture and the changing content of cultural rights from 1948 Universal Declaration of Human Rights to 2005 Convention on Protection and Promotion of Diversity of Cultural Expression. During this period still descriptive relativism has been dominant and cultural rights on the level of concept concretize and expand themselves into the domain of universal human rights. I argue against fundamental reductionism to regard human rights as inviolable natural rights and fetishism to regard them as the only result of political struggle. In other words, we should admit that desire for universal human rights may have real validity as symbolic fiction and the concepts & contents of human rights have changed as a result of political struggle within the nation states. In concluding part this paper suggests three combinations for deliberation to reach morally justifiable universal human rights beyond cultural difference.
