혐오표현은 특정 개인(들)을 대상으로 언어를 통해 수치심 등 정신적 고통을 주는 괴롭힘과, 불특정 혹은 다수의 청자로 하여금 소수자 집단에 대한 적대감을 갖도록 유도하고 사회적 배제와 차별을 조장하는 증오선동으로 크게 나뉠 수 있다. 괴롭힘과 증오선동 모두 그 규제의 근거는 주요 국제인권조약의 차별금지 조항과 법의 평등한 보호 조항에서 도출된다. 국가는 차별로부터 모든 사람을 보호할 의무를 지니며, 혐오표현으로부터 사회적 소수자들을 보호하는 것 역시 그러한 의무의 일환으로서 요구되는 것이다. 나아가 자유권규약 제20조 제2항, 인종차별철폐협약 제4조(a) 등은 증오선동의 법적규제를 국가의 의무로서 명시적으로 요구한다. 본 논문은 국제인권규범과 국제판례를 통해 증오선동의 규제와 관련된 주요 쟁점을 분석, 고찰한다.
증오선동은 대상이 되는 소수자들의 존엄성을 훼손할 뿐 아니라, 소수자에 대한 사회적 편견을 고착시켜 이들의 평등권과 공적인 장에의 참여를 제약한다. 이러한 현상의 만연은 민주주의와 사회적 공존을 위태롭게 하는 등 공동체 전체에 해악을 발생시킬 수 있다. 따라서 국제인권법의 기본 가치인 차별금지와 평등 원칙에 입각하여, 소수자 인권의 보호를 위한 실질적인 법적 규율의 일단계로서 차별금지법의 제정과 증오선동을 포함한 혐오표현의 법적 규제가 요구된다. 증오선동의 법적규제는 소수자들의 존엄에 대한 공격을 용인해서는 안 된다는 공동체적 연대의 메시지를 사회에 전달하기도 한다. 소수자에 대한 편견과 불평등의 사회적 고착과 확산을 막기 위해 그 원인과 실태에 대한 연구 및 정책 마련, 인권교육 및 홍보 등 종합적 접근이 수반되어야 함은 물론이다.
증오선동 규제를 위한 입법 과정에서 소수자 인권의 보호와 표현의 자유를 균형 있게 조화시키는 것은 핵심적 과제이다. 표현의 자유는 개개인들이 자아를 실현, 발전시키는 데 필수적 조건이며 민주사회의 기초로서 매우 중요한 가치를 지닌다. 증오선동 규제 입법에 있어서, 사상의 자유 시장의 자율규제 능력에 대한 맹신이나 법을 통한 평등 증진에 대한 이상주의적 기대를 모두 경계하면서 균형점을 찾는 것은 어렵지만 견지해야 할 기본 원칙이다. 증오선동 규제 관련 주요 쟁점에는 규제대상, 보호되는 집단의 범위, 표현과 해악 간의 개연성에 대한 기준, 목적성 등이 포함될 것이다. 증오선동이 해악을 야기하는 사회적 과정과 국제인권규범을 고려할 때, 차별이나 물리적 폭력이라는 구체적 행위의 선동뿐 아니라 소수자 집단에 대한 적대감을 조장․선동하는 표현까지 규제 대상에 포함시키는 것이 합당하다. 증오선동 규제에 의해 보호되는 집단은 증오선동의 피해 실태 및 차별에 대한 취약성 등을 고려해 그 범위를 정하는 것이 ‘법의 평등한 보호’에 부합하는 것이자 자유권규약 제20조 제2항의 발전적 이행이라고 볼 수 있다. 증오선동 행위 구성 여부는 전체 맥락 속에서 표현과 해악 간의 개연성과 발화자의 목적성(고의성)을 중심으로 판단해야 할 것이며, 형사적 규제냐 비형사적 규제냐에 따라 그 기준을 달리 하는 것을 검토해 볼 수 있다. 즉, 처벌을 주된 목적으로 하는 형사적 규제 시에는 국가형벌권의 남용을 막기 위해 목적성 요건과 개연성 기준을 엄격히 하고, 비형사적 규제 시에는 그 기준을 완화해 해악의 예방과 소수자 보호에 보다 중심을 두는 방...

Hate Speech includes harassment that causes particular individuals a sense of humiliation and degradation through verbal acts on the basis of prohibited grounds, and incitement to hatred which promotes hostility towards marginalised groups among indiscriminate or a large number of audience and induces social exclusion and discrimination. Regulations of harassment and incitement to hatred both derive from non-discrimination and equal protection of the law enshrined in the international human rights treaties. The States have an obligation to guarantee all persons equal and effective protection against discrimination, which includes protecting marginalised groups from hate speech as an essential element. Furthermore, prohibition of the incitement to hatred by law is explicitly required by Article 20(2) of the International Covenant on Civil and Political Rights and Article 4(a) of the International Convention on the Elimination of All Forms of Racial Discrimination. This article discusses key issues concerning the regulation of the incitement to hatred, examining the relevant international human rights norms and international jurisprudence.
The incitement to hatred not only destroys the human dignity of targeted groups and individuals, but also entrenches the prejudice against those groups and thus impedes their equal rights and public participation. When becoming prevalent, such phenomena may threaten democracy and peaceful co-existence of diverse groups, resulting in harms to the society as a whole. Therefore, on the basis of the principle of non- discrimination and equality which is a fundamental value of international human rights law, a comprehensive legislation combating discrimination and the regulation of hate speech including the incitement to hatred are required as the first step of a legal framework for the protection of marginalised groups. The regulation of the incitement to hatred also sends our society a message of solidarity that attacks upon dignity of marginalised groups shall not be allowed. Without doubt, it should be accompanied by a comprehensive set of measures to prevent the prevalence of prejudice and inequality, such as research and policies addressing its causes as well as education to raise awareness.
Balancing and harmonising the right to equality and freedom of expression is a key task in making legislations regulating incitement to hatred. The freedom of expression entails an important value as a necessary condition of the realisation and development of human persons, as well as a basis of democratic society. Seeking such balance, away from both ‘a blind faith in the so-called free market of ideas’ self-regulating powers’ and ‘idealistic expectations about the role of law in promoting equality’ is not an easy task, but one of the basic principles in regulation of the incitement to hatred. In regulating the incitement to hatred, key issues include the scope of regulation and protected groups, the standard regarding the likelihood of harms, and the purpose or intent of the speaker. Considering the international human rights norms and the harms resulting from the incitement to hatred, it is reasonable that not only incitement to concrete acts of discrimination or physical violence, but also incitement to hostility towards the marginalised groups fall within the scope of the regulation. The protected groups from the incitement to hatred must be defined, considering the situation of incitement to hatred and vulnerability of the groups to discrimination. This principle is consistent with ‘the equal protection of the law’ and the progressive implementation of Article 20(2) of ICCPR. What constitutes the incitement to hatred must be evaluated on the basis of the likelihood of harms and the purpose of the expression in the relevant context.
