표현의 자유에 대한 사전억제 법리의 문제점 고찰 = 방영금지가처분 결정 사례 분석을 중심으로

국문 초록 (Abstract)

최근 몇 년 동안 방영금지가처분 신청 사건이 급증하였다. 방영금지가처분 제도가 언론의 자유에 대한 본질적인 위협인지, 아니면 인격권의 침해와 언론자유간의 갈등을 규범조화적으로 해결하기 위한 장치인가에 대한 이론적 탐색과 실증적 사례 분석이 필요하다. 이 연구는 방송사를 대상으로 신청한 방영금지가처분 신청사건의 판결ㆍ결정문을 수집하여 신청제도의 운영상 특성, 또 심판에 나타난 법리의 특성을 분석하였다. 연구결과, 한국의 법원은 사전금지가 검열에 해당하지는 않으나 언론자유에 대한 제약이 된다고 판단하면서도, 실제 시판의 기준은 모호하고 일관적이지 못한 것으로 나타났다.

다국어 초록 (Multilingual Abstract)

Freedom of the press can be viewed as providing two modes of protection. One is freedom from prior restraint and the other is freedom from unreasonable subsequent punishment, From the perspective of freedom of the press, the legal concept of prior restraint is of significant importance. This study attempts to explain the nature of injunction, especially the Provisional Disposition Rulings imposed on various television programs in Korea The results of the study are summarized as follow. First, freedom of expression is believed to be an indispensable right to develop the personality of individuals and to form a democratic order. Second, the standards or rationale for decisions are ambiguous and inconsistent in lawsuits related with the provisional disposition rulings against television programs.
