This year, Korean Congress tried to revise Article 98-2 of Congress Act and reinforce the control power of Korean Congress against the administrative regulation. The bill passed the plenary session of the Congress but the President exercised veto power against the bill alleging that the bill was against the Constitution. This paper aims at examining whether the bill is against the Constitution as the President alleged it and analyzing the case in the perspective of constitutional law. To achieve the aim, this paper will overview the history of congressional review system of administrative regulation in Korea at first, and will examine whether the bill is against the Constitution violating the separation of power principle provided in Korean Constitutional Law. It will also examine the congressional review system of administrative regulation in the United States as well as in the United Kingdom in the comparative law perspective. Finally, based on the examinations, this paper will explore the desirable reform measures in congressional review system of administrative regulation in Korea.
