독일의 이주자정책 : 사회적 통합과 배제의 딜레마

국문 초록 (Abstract)

본 논문은 독일의 이주정책을 살펴보는데 목적을 두고 있다. 독일은 2005년 이민법을 제정하고 이를 통해 체계적인 외국인 통합정책에 많은 노력을 기울이고 있다. 독일의 경우 높은 수준의 경제력과 사회복지 및 비교적 자유로운 외국인 관련법으로 인해 많은 수의 외국인 노동자와 정치적 망명자 및 난민들이 유입되었으나 대부분의 외국인 이주민들은 독일사회에 통합되지 못한 채 분리되어 살아가고 있는 실정이다. 이주에 대한 규제를 완화하는 이민정책을 수립한 것은 한편으로는 독일의 인구통계학적 상황에서 외국으로 부터의 노동력의 유입이 절실하게 필요하기 때문이지만, 다른 한편으로는 급증하는 이주의 증가와 이로 이해 발생하는 사회적․안보적 상황에 보다 적극적으로 대응하기 위한 정책으로 평가할 수 있다. 이와 같은 문제의식을 기반으로 본 논문은 세계화 현상, 유럽통합 그리고 독일에서의 이주문제를 살펴보고, 독일 이주정책의 역사적 전개과정 및 효율성 제고를 위한 배제와 통합의 딜레마라는 틀 속에서 새로운 독일의 이민법을 분석하고 독일 이주정책의 패러다임의 변화를 체계적으로 설명하고자 한다.
또한 이민법을 통한 독일의 새로운 외국인 통합정책을 살펴보고 문제점과 한계를 지적 해보고자 한다.

다국어 초록 (Multilingual Abstract)

The purpose of this paper is to analyze the immigration policy of Germany. By reform the immigration policy in 2005, Germany has been trying hard on establishing a better organized policy for integration foreigners. Although Germany's high economic and welfare system and relatively open laws against foreigners brought many foreigner workers and political refugees into the country, but they have not integrated themselves as one. Setting a immigration policy through reform the immigration law and easing the regulations against immigration has two meanings. One is for Germany's desperate need of foreign labor. Another is for the country's correspondence against problems that occurs in the social and security field due to the increase of immigration. This paper aims to look over the EU-integration and the immigration issues in Germany. Also through the historical development of immigration policy and ‘the dilemma of social integration and exclusion, this paper hopes to analyze Germany's new immigration law and explain the changes in the country's immigration policy paradigm. Indicating the problems and boundaries of the new foreign integration policy through the immigration law is another aspect this paper plans to cover.
