방송의 자유와 중대 보도의 공정성 긴급심의 제도 연구

다국어 초록 (Multilingual Abstract)

Prime Minister-designate Moon Changkeuk withdrew his nomination on 24th June in 2014 amid mounting criticism over past controversial remarks. Moon’s withdrawal came two weeks after he was nominated for the nation’s highest unelected official post. Moon was under fire over controversial remarks he made on the 1910-45 Japanese rule of the Korean Peninsula. In a speech delivered at a church in 2011, Moon said Japan’s 1910-45 colonial rule of the Korean Peninsula and the division of the country was God’s will.
After KBS broadcasted that Moon idealized Japanese occupation on 11th June, there occurred conflicts between supporters and opponents. It raised many problems on the fairness and the objectivity of news, the accountability of public service broadcast, democratic formation of public opinions. Of course we should keep the freedom of broadcast which is the cornerstone of liberal democracy and the origins of self-rule. But it has limitations that broadcasters must do their’s public accountability and that they must keep fairness and neutrality, objectivity etc..
Korean program review system has many problems and has stirred the constitutionality. Because it has many aspects of abridging the freedom of broadcast, I have tried many legislative reformative solutions. I have studied cases of developed countries including U.S.A. and England, Germany and so on. In this study the nature of the freedom of broadcast and news gathering and reporting have been scrutinized deeply. Especially I have concluded that the nature of news gathering and reporting is administrative action.
I have urged to clarify the concept and standard of fairness to legislators and I have tried to criticize unconstitutionality of program review system. We are able to conclude that program review system will disappear if liberal democracy will be rooted deeply. I suggest that self review is the best way to remove the conflicts on reports and news. And I emphasize that we shall have urgent program review system which will solve the conflicts of news fairness.
At last I hope that broadcasters should broadcast news and programs fairly and that people should be well informed and discuss all public affairs, be able to strengthen liberal democracy. We should give the access rights to broadcasters to people who want to express in the marketplace of ideas i.e. broadcast media. Legislators should arrange the institutions of program review to lessen fallacy and to attain the truth.
