자율방범대 법률 제정 방향에 관한 논의 : 자율방범대원과 경찰공무원의 인식을 중심으로 = A Discussion on the Legislation of Police Volunteer Law : Focusing on the Perceptions of Police Volunteers and Officers

The purpose of this study is to discuss appropriate directions of the Police Volunteer Law by examining perceptions of police officers and volunteers. The discussed topics are based on the 'Public Hearing for the Legislation of Police Volunteer Law' on April 21, 2009. This study investigated both police officers and volunteers from the Jeonbuk Provincial Police Agency on March 1, 2011 and reported the results in the below.
First, it is important to clarify the legal characteristics of the Police Volunteer Law in order to legislate the Law which organizes and manages police volunteers. According to the survey, participants perceived police volunteers as the supplementary personnels for the better police services.
Second, in the examination of the proper ages of police volunteers, more than half of police officers and volunteers chose the below 50s as the appropriate ages. This result shows that participants prefer relatively young volunteers. However, some other participants did not regard the age limitation, considering that volunteer’s main duty would be assistants to the police. Therefore, the respective regional police agency needs to decide the ages of volunteers based on the demand of police service.
Next, the conditions of disqualification should be based on voluntary quitting, moving to the other location, or irresponsible working attitudes. In order to revitalize the police volunteers, there should be not only the aftermath disqualification, but also more proactive approaches.
Third, both police officers and volunteers perceived the police volunteers as the supplementary personnels for providing better police services. Generally speaking, it is recommended to regulate the activities of police volunteers in order to prevent the violation of human right and the abuse of power.
Lastly, in the matter of the system to support and award the police volunteers, it can be appropriate for their budgets to be supported by the local government. But, if the management is handled by the regional police agency, there could be conflict between two different governmental parties. Therefore, it is recommended to unify the budget and management agencies into single organization for the police volunteers.
During the legislation period, there should be a discussion on the possibility of local governments providing budgetary support to the regional police agencies indirectly for the police volunteers. Regarding the types of supports, participants expected the provision of facilities from the police agencies and monetary and legal supports from the local governments.

국문 초록 (Abstract)

이 연구의 목적은 2009년 4월 21일에 개최된 ‘자율방범대 법 제정을 위한 여ㆍ야 공청회’에서 발의된 사항을 토대로 문헌연구와 자율방범대 인식조사를 통해 자율방범대 관련 법률 제정 방향을 논의하고자 하는 것이다.
2011년 3월 1일에서 20일까지 전북지방경찰청 자율방범대원과 경찰공무원을 대상으로 법률 제정 방향에 관한 인식조사 결과는 다음과 같다.
첫째, 자율방범대의 법적 성격에 대한 자율방범대원과 경찰공무원의 인식조사 결과, 자율방범대를 치안서비스를 제공하는 예비치안인력으로서 인식하고 있었다. 둘째, 자율방범대원의 연령에 관한 인식조사 결과, 자율방범대원과 경찰공무원 모두 50세 이하가 과반수로 가장 높게 나타나 젊은 층을 선호하고 있었다. 다음으로, 자격상실 요건에 관해서는 자율방범대원 대부분이 본인의 희망에 의하거나 타 관내로 퇴거하거나 근무태도가 불량ㆍ불성실한 자에 대해서는 자격을 상실해야 한다고 인식하고 있었다. 셋째, 자율방범대 임무에 관한 자율방범대원과 경찰공무원의 인식조사 결과, 두 집단은 모두 자율방범대를 치안서비스를 제공하는 예비치안인력으로서 인식하고 있었다. 마지막으로 지원형태에 관한 인식조사 결과, 경찰에서는 각종 장비 보급을, 지방자치단체에서는 활동비 지원과 법 규정 마련을 해야 한다고 나타났다.
이와 같은 인식조사 결과를 토대로 자율방범대는 경찰청 산하에 두어 관리하는 것이 바람직하며, 자율방범대원의 연령은 지방경찰청별로 필요한 치안임무에 따라 정해야 할 것이다. 또한, 자율방범대는 예비치안인력으로서 인권침해와 권력남용의 우려가 있어 자율방범대원의 활동범위를 제한하는 규정을 둘 필요가 있다. 마지막으로 자율방범대의 지원ㆍ포상제도와 관련하여 자율방범대의 예산지원은 지방자치단체가 하는 것이 가장 바람직할 것이나, 관리ㆍ운영을 경찰청에서 하게 되면 지원과 운영이 이원화되는 문제가 생긴다. 따라서 자율방범대의 지원과 운영을 일원화할 수 있도록 할 필요가 있다.
