국가와 지방자치단체 간의 갈등구조 및 그 해결시스템 모색

다국어 초록 (Multilingual Abstract)

Harmony of National and local governments are required to achieve two goals of globalization and localization. These situation leads to confliction between national and local governments in many aspects. Here, it is necessary to review what local sovereignty is based on and what it is in essence.
As to sovereignty of local governments, local autonomy, there are several theories to explain about. Among them, theory of organizational guarantee is supported by most scholars and held by the Supreme Court. However, It is not easy to define what the essence of local autonomy of this theory is. Therefore this paper focuses on theory of new inherent right understanding local autonomy as relation of basic rights guarantee principles and popular sovereignty.
First, studying presents regulations on national and local autonomy governments, this paper continues to consider share duties principle, subsidiarity principle and local government. Considering how much autonomy of local governments is guaranteed from intervention of the national government, how national government intervenes and then how local governments could be protected, this paper tried to comprehensively understand relations of national and local governments.
This paper studies Korea's theories and cases on conflicts of national and local governments according to each relation of legislating, administrative and judical authority. Analyzing results of reforming Japan's local autonomy law as a role model, this paper tries to apply them for that of Korea.
In order to find solution system for national and local governments conflicts, it studies solution system for conflicts with national legislation power and with national administrative power.
At last, referring to legislative bills of Japan's Basic Local Government Act, I suggest legislative solutions for fundamental reforms of present local autonomy act of Korea.
